SENATE PROTECTS SCHOOL CUSTODIANS

The House and Senate approved and sent to Gov. Baker a bill designed to protect the rights of custodians, cafeteria and other non-teaching employees of school districts by exempting them from the Education Reform Act or 1993. That act gave school principals strong control over the hiring and assignment of teachers and other education professionals as part of the effort to improve test scores and overall student performance.

SENATE TO INCREASE DEEDS EXCISE TAX FROM $20 to $50

Senate 38-0, approved an amendment raising the state deeds excise tax from $20 to $50. The deeds excise tax is paid by the seller of the property and funds the state’s Community Preservation Act Trust Fund that “matches” the money raised by local cities and towns which are allowed to impose a surtax on real estate sales to fund projects like affordable housing, preservation of historical resources and open space.

IMMIGRATION STATUS AMENDMENT APPROVED

The Senate 25-13, approved an amendment that would prohibit police and other law enforcement from asking people about their immigration status. Other provisions end the practice that deputizes state and local law enforcement as U.S. Immigration and Customs Enforcement (ICE) agents; bans state resources from being used to create a registry based on ethnicity, religion, country of origin and other criteria; and requires that immigrants be notified of their due-process rights.

MENTAL HEALTH BILL AMENDMENT REJECTED

House 42-111, rejected an amendment that would require the court, within 24 hours of the issuance of an ERPO, to assign a mental health counselor to evaluate the individual, assess counseling needs and establish a counseling outline and program. It also requires the Department of Mental Health, if considered necessary, to establish a mental health counseling program for the individual and report back to the court.

House 139-14, approved and sent to the Senate a bill that would allow family or household members to petition the courts to issue an extreme risk protection order (ERPO) that would suspend a person’s license to carry a firearm and order him or her to surrender his or her firearms and ammunition if he or she is believed to be a danger to themselves or others.

HOUSE APPROVES HIKE CAR RENTAL TAX BY $2 TO FUND POLICE TRAINING

House 149-4, Senate 37-0, approved an amendment imposing a $2 tax on car rentals to fund municipal police training.

Amendment supporters said the small fee would raise up to $10 million annually for this fund established by the criminal justice law signed by Gov. Charlie Baker last month.

Somerville-City Awards $8.2M in CPA Funds to Open Space and Historic Resources & 100 Homes Project, Now Accepting New Applications

Follows $1.2M in funding for affordable housing

SOMERVILLE – This month, the Somerville Board of Aldermen approved and allocated more than $8.3 million in Community Preservation Act funding to ten open space and historic preservation projects and the 100 Homes Initiative, upon the recommendation of the Somerville Community Preservation Committee (CPC). The Aldermen previously approved the CPC’s recommendation to provide $1,200,402 to the Affordable Housing Trust Fund in March.

City Submits Proposal for Relocation of Public Safety Building to Former Site of Cobble Hill Shopping Center

New site at 90 Washington St. would house SPD Headquarters and SFD Engine 3.

SOMERVILLE – Mayor Joseph A. Curtatone announced today that the City has formally submitted a borrowing authorization request and a request for appropriation to the Board of Aldermen to acquire the parcel at 90 Washington St., to relocate the Somerville Police Department Headquarters and Somerville Fire Department’s Engine 3. 90 Washington St., the former site of the Cobble Hill Shopping Center, has been vacant since 2014, and was identified as the most ideal location for the new Public Safety Building through a space needs assessment and site review of several parcels of land within the city limits that met identified space requirements. PROPOSAL TO HIRE RETIRED POLICE AS SCHOOL RESOURCE OFFICERS

The Education Committee held a hearing on a proposal that would allow cities and towns to hire retired state and local police officers to be full-time safety resource officers at local schools. Under current law, there is a 960-hour limit on the number of hours these officers can work in municipal or state government. That translates into approximately 120 eight-hour days.

ASSAULT ON HEALTH CARE WORKERS IS A FELONY

The House gave initial approval to a bill that would make it a felony and increase from 2.5 years to five years the maximum prison sentence that could be imposed on offenders convicted of assault or assault and battery on an emergency medical technician (EMT), ambulance operator, ambulance attendant or health care provider including doctors, nurses, social workers and chiropractors. The bill also abolishes the current 90-day mandatory sentence for the crime.

JUDICIARY COMMITTEE PROHIBITS POLICE OFFICERS SEX WITH SUSPECT

The Judiciary Committee held a hearing on legislation that would impose a prison sentence of up to five years and/or a $10,000 fine on any police officer who engages in sexual relations with anyone who is under arrest by the officer or another officer. The measure states that a person is incapable of consenting to sexual relations with officers under those circumstances. This law currently applies to prison guards and this bill expands it to police officers.

“RIGHT TO DRY” ALLOWED by SENATE

The Senate approved a local option proposal that would prohibit a city or town from outright banning any homeowner or tenant from using a clothesline to dry clothing. The law would only take effect in cities or towns that opt into it. Condominium associations and landlords would be allowed to place reasonable restrictions on the placement and use of clotheslines but could not ban them completely.

On 5/08/18 around 8:03 p.m., while assigned to the Somerville Police Narcotics Unit and working in plain clothes capacity, my attention was drawn to a dark colored motor vehicle with excessive tint that was parked in a posted no parking zone on New Washington Street, a public way within the city of Somerville. Real Life Somerville Police Stories: Douglas BRIOSO (Firearm Carry, Deface Firearm Serial No., PWID D)

On 05/07/2018, I, Officer Christopher Collette was assigned to Somerville marked unit West Seven. At approximately 23:37 hours, I was dispatched to the area of 13xx Broadway, for the report of threats involving a firearm. Officer Clark was dispatched as well. While en route, Somerville Control advised all responding units that the suspect vehicle was a white sedan. STATE TO GET MUSICIAN LAUREATE

The Senate approved and sent to the House a measure creating the new position of the State Musician Laureate. The laureate, appointed by the governor biennially, would write and/or perform music to commemorate important events such as ceremonial occasions, celebrations and state anniversaries; act as the governor’s adviser in musical matters; and represent the state’s musical legacy.

MASSACHUSETTS TO ALLOW 12- AND 13-YEAR-OLD KIDS TO REFEREE SOCCER

This bill allows 12- and 13-year-old boys and girls to referee and get paid to referee an official youth soccer game with only players younger than 12. Games would be limited to intraclub/intown scrimmages with no results or standings. The employment would be allowed only with written parental consent, written communications to the parents from the employer about the minor’s responsibilities, the youth’s completion of a job training program and an adult representing the employer at the game.

MASSACHUSETTS BILL PASSED TO PROTECT SERVICE ANIMALS

This bill makes a person who uses an assistance animal eligible for victim compensation if his or her animal is injured or killed by a person. The compensation would include veterinary medical expenses and the replacement cost of an equally trained assistance animal if the animal dies or is too injured to return to work.
