

On Thursday, May 11, 2017, while working in marked cruiser West 5, I observed Massachusetts registration number XXXXX, fail to stop for a red light at the intersection of Broadway and Warner Street. Both streets are public ways in the City of Somerville.
I activated my blue lights and stopped said vehicle on Broadway at Walker Street, also public ways in the City of Somerville. I then observed the windows to be tinted so dark that I could not see the operator.
I spoke with the operator, Mr. Alain Pierre-Louis, and immediately could detect the odor of burnt Marijuana emanating from his vehicle. I asked him if he had any more marijuana in the car and he handed me a plastic bag containing two marijuana cigarettes. I informed him that having an open container of marijuana in the passenger compartment is a civil infraction and the marijuana will be subjected to forfeiture.
I also observed he was not wearing his seat belt and informed him I wanted to test the transparency of his windows. I then placed my tint meter on the window and let him observe that there was only 15% total light transmitting through. The legal minimum is 35% TLT.
When asked for his license and vehicle registration, Mr. Pierre-Louis stated he did not have his driver’s license with him but assured me he did actually have one. A registration check of Mr. Pierre-Louis returned that his license status was suspended in Massachusetts.
With the assistance from Officer Anderson, West 6, I instructed Mr. Pierre-Louis to exit the vehicle and that he was under arrest for Operating a motor vehicle after license suspension, c90s23 and called for the transport wagon.
Mr. Pierre-Louis was transported to the station where he was booked in the usual manner by Lieutenant DiGregorio for the following charges;
1. Operating a motor vehicle after license suspension, c90s23,
2. Failing to stop for a red light, c89s9,
3. Fail to wear safety belt, c90s13a
Mr. Pierre-Louis was issued a Massachusetts Uniform Citation number R8607967 for the above charges, and a City of Somerville Municipal Ordinance Violation number #58951 for having an Open Container of Marijuana inside a vehicle, c94gs13d
The owner of the vehicle, YYYYY of Randolph MA, was issued Massachusetts Uniform Citation number#R8607968 for having tinted windows, c90s9d.
Prior to Pats Tow Company removing the vehicle I did my motor vehicle inventory, and observed another marijuana cigarette in the center console, cup holder along with a glass pipe containing what I believe to be a small amount of marijuana wax or BHO. All will be entered for destruction.
