On the morning of May 13th, 2017, while in uniform, I was assigned to marked unit East-2. At 11:23 AM, I was dispatched, along with Ofc. Collette, to 30X Somerville Ave, (Union Square,) for a report of a male threatening an off duty firefighter, later identified as XXXXX. Additional information came over the radio that there was an off duty Police Officer, (Ofc. Nevin.) Ofc. Manzelli responded for back up.

        Upon our arrival, we were met by Ofc. Nevin and a party that is well known to all officers, (Mr. Chris REYES.) While officers were walking towards REYES, he was screaming, “ask the firefighter,” “talk to the firefighter,” in a loud, angry manner. I observed many people stopping what they were doing to look at REYES. REYES then stood up from the bench he was sitting on. Ofc. Manzelli and I asked him to sit back down. REYES said “fuck you, you want to go?” He then attempted to strike me with a closed fist on the left side of my head. As I went to block his punch he grabbed my jacket with his other hand. Ofc. Collette, Ofc. Manzelli, Ofc. Nevin and I were able to get REYES down to the ground. Ofc. Manzelli was able to get one handcuff on REYES’ right hand; however he was still trying to fight us with his left hand. He was ordered numerous of times to stop resisting and to give us his other hand. REYES ended up complying after a very short period.

        Once REYES was cuffed, he continued to scream loudly and was using many profanities. I would add that at this point cars had stopped to see what was going on.

         Based on the facts, REYES was taken into custody for the charges of disorderly conduct, A&B on a Police Officer, and resisting arrest. Unit 200 was requested. REYES was booked by Lieutenant Digregorio in accordance with department policy.

        I was then able to speak with XXXXX. She told me that she was walking into Union Square with two of her friends, when they came across REYES. XXXXX, who knows REYES from dealing with him all the time, said hi to REYES. She went on to say that after she said hi, REYES started screaming at her. When asked if she remembers what REYES said, XXXXX stated that he said, “fuck you,” “I am going to fucking kill you,” and “I want to fuck you up.” For those comments, REYES was also charged with threats to commit a crime.
