On March 27, 2014 at approximately 1730 I was in full uniform and assigned to the Somerville Police Traffic Bureau. I was posted on Summer Street, a
public way and posted 25 MPH Zone within the City of Somerville, by my supervisor to enforce any and all violations. I was conducting speed enforcement when I observed a 2002 Mercedes S230 color white, traveling east on Summer Street from Willow Ave at an estimated 35 MPH. I directed my lidar unit at the vehicle and got a reading of 37 MPH at a distance of 230.5 feet. I made a U-Turn with my lights and siren activated and stopped the vehicle outside 269 Summer Street. I approached the operator, the defendant in this matter, and requested his license and registration. The defendant asked why he was being stopped and I told him while he searched for the registration. I detected an odor of Marijuana emanating from within the vehicle, although not an overwhelming odor. The defendant finally handed me the registration along with his Massachusetts ID Card. Officer, Tango 5, arrived on scene as backup. I queried the defendant through the RMV and got no record of a license, however, I did find a record of a Massachusetts permit. Since the defendant was the lone occupant in the vehicle I concluded he was in violation of Chapter 90 Section 10, being not duly licensed. I called for a tow and the mobile detention unit, and also issued citation.
