Real Life Somerville Police Stories: (Assault w/ Dangerous Weapon)

On Wednesday, May 18, 2022, at 11:29 PM, Somerville Police control received a 9-1-1 call from a male identified as XXXX (Victim), reporting a male pulled a knife on him outside XXX Broadway. The victim told the 9-1-1 operator that the male had left the area and went towards Stop & Shop on McGrath Hwy.

I, Officer Richard Lavey III, along with Officer Messaoudi responded to XXX Broadway. Officers Campers, Khoury, Catatao, and Pavao responded as backup.

Upon arrival, the victim spoke to Officer Campers in Portuguese, stating he went to Maya Sol Restaurant, 179 Broadway, Somerville, to inquire if the owner of the restaurant had video cameras outside. The victim indicated his tools had been stolen from his work van and he wanted to know if the incident had been recorded on video.

According to the victim, a heavy-set Brazilian man was sitting at the restaurant and overheard his conversation with a restaurant employee. The man followed the victim to his home, pulled out a folding knife, aimed it at him, and said in Portuguese, “I’m going to get you, I’m going to kill you.”

The victim described the person who pulled the knife on him as a heavy-set male, wearing a blue shirt, shorts, and sneakers. Officer Khoury located a male identified as Luciano DELIRA (Defendant), matching the description walking from Kensington Ave. onto Broadway. This corroborated the victim’s statement of the defendant fleeing toward Stop & Shop. It appeared that the defendant walked back to Broadway after seeing two State Troopers on a road detail outside Stop & Shop.

Officer Messaoudi read the defendant his Miranda Rights from a card and asked the defendant if he wished to speak with him. The defendant stated “Yes” and told Officer Messaoudi that the victim had accused him of stealing his tools and pointed a gun at him. Officer Messaoudi inquired as to why the defendant was returning to the victim’s residence, to which the defendant said, “I wanted to confront him because he pulled a gun on me.” Officer Messaoudi questioned the defendant about why he would confront someone who pulled a gun on him instead of calling the Police. The defendant remained silent.

I located a witness named XXXX. He stated he was sitting on a bench near the corner of Broadway and Garfield Avenue when he witnessed the defendant and the victim argue outside XXX Broadway, but he did not witness the assault because it was too far away to know if a weapon was used. I asked the witness if he could describe the defendant and he replied by stating it’s the guy you have detained.

I placed the defendant under arrest for assault with a dangerous weapon c.265 S15B. He was transported to the Somerville Police headquarters in unit 200, which was operated by Officer Prophete, and booked by Lieutenant Deoliveira for the above-mentioned charges.
