Real Life Somerville Police Stories: Javier FABIAN-DUBON (Destruction of Prop, Disorderly)


On the above date and time, Officer Messaoudi and I, were dispatched to Fasika, 147 Broadway, for a dispute.

As units were responding to 147 Broadway, Somerville Control informed responding units that the defendant, Javier Fabian-Dubon, fled the scene heading in the direction of Stop and Shop located on McGrath Highway. Officer Lambert located Fabian-Dubon on Mystic Avenue behind the Stop and Shop hiding in the bushes near the loading dock. When I arrived to Officer Lambert’s location, I observed Fabian-Dubon had been handcuffed.

Officer Khoury, spoke to an employee, XXXX, of Fasika. XXXX stated that Fabian-Dubon walked into the bar and requested to be served an alcoholic beverage. Due to Fabian-Dubon’s level of intoxication, XXXX refused to serve Fabian-Dubon. Fabian-Dubon became extremely angry with XXXX for not serving him an alcoholic drink. Fabian-Dubon picked up a bar stool and threw it behind the bar at a wall of glass shelves which had numerous bottles of alcohol. The glass shelves broke/shattered and the bottles fell onto the counter and floor and also broke. At the time of the incident, three patrons and three employees, were in Fasika.

Photographs of the damage to the bottles and shelves were taken by Officer Khoury. Fabian-Dubon admitted to me, that he had consumed eight Corona Light beers. Fabian-Dubon was placed under arrest, and transported in prisoner transport vehicle, Unit 200 to the Somerville Police Station where he was booked and processed in the usable manner.
