On 06/22/2017, at approximately 21:00, I Officer Brioso (East 3), along with Officer Moreira (East 4) was dispatched to 3 Dartmouth St for a report of an injured party. BREEN, Wendy called 911 to report that her brother BREEN, Robert was intoxicated and had fallen causing a laceration to his head. Upon my arrival I observed Mr. Breen on the front porch grabbing and pushing Somerville Firefighter Michael Khoury, and Cataldo EMT David Gomez-Colon, while yelling repeatedly “I’m not fucking going anywhere” “fuck everybody”. While emergency personnel were trying to tend to his injuries, Mr. Breen continued to yell profanities causing neighbors to look out of their windows and pedestrians stopped and appeared to be alarmed by his tumultuous behavior.

 

I asked Mr. Breen to keep his voice down because he was causing a scene. Mr. Breen responded by yelling “Fuck you”. At that point he stood up from a seated position and pushed me in the chest. I told Mr. Breen that I was placing him under arrest for Disorderly Conduct and Assault and Battery on a Police Officer. Mr. Breen attempted to strike me again but I was able to grab hold of his arms preventing him from doing so. Mr. Breen was actively resisting by not placing his arms behind his back as instructed. At one point we all fell on the floor of the front porch. With the help of Officer Moreira, I was able to place the handcuffs on Mr. Breen. While we were on the floor Ms. Breen kicked me several times on my buttock and legs. Somerville Firefighters were able to pull Ms. Breen away from me. I then told Ms. Breen that I was placing her under arrest for Assault and Battery with a Dangerous Weapon (shod foot). I asked Ms. Breen to place her hands behind her back and she refused to do so. I grabbed a hold of her arm and she pulled away causing the both of us to fall to the floor. After a brief struggle I was able to place the handcuffs on Ms. Breen. Ms. Breen will also be charged with Resisting Arrest.

 

Mr. Breen is also being charged with two counts of Assault and Battery on a Public Employee for assaulting Firefighter Michael Khoury and EMT David Gomez-Colon.

 

Mr. Breen and Ms. Breen were transported to Somerville Police Headquarters via Unit 200 Officer Pavao, where they were booked in the usual manner by Lt. DeOliveira.

 

Ms. Breen’s New Balance running sneakers were confiscated and submitted as evidence.
