Real Life Somerville Police Stories:James McLaughlin (Shoplifting, Trespass)Express Factory Outlet at Assembly Row

On Saturday, January 30th, 2016, I, Officer Devin Schneider, was in full uniform assigned to marked unit East-4 during the evening shift. The following report is a summary of events that I witnessed that night, as they pertain to incident #16005478:

At approximately 7:17 PM I was dispatched to 301 Artisan Way, the Express Factory Outlet, for a report of a shoplifting in progress. I arrived a short time later along with Officer Christopher Fusco (East-3). I met with one of the store employees, XXXXX. XXXXX stated that a male and female had entered the store together. The female had opened a line of credit and purchased approximately $250 worth of clothing for the male. The male, then selected a t-shirt from one of the store displays, and concealed it in his coat before leaving the store. Cortes described the male as a white male, wearing a red hooded sweatshirt, facial hair, and several red marks on his face.

Officer Fusco left the store to search the area, and located a male matching the description inside the Adidas store. Officer Fusco placed the Suspect into handcuffs for safety purposes. I joined Officer Fusco at the Adidas store, where I met with the Suspect, subsequently identified as James McLaughlin. Mr. McLaughlin had three large Express bags full of merchandise with him. I returned with Mr. McLaughlin to the Express store.

Officer Fusco read Mr. McLaughlin his Miranda rights from a pre-printed card. I questioned Mr. McLaughlin, who admitted that he stolen two shirts that were in his bag, as well as the black hat he was wearing, and that the merchandise was stolen from Express. Additionally, Mr. McLaughlin stated that he had stolen a pair of grey Air Jordan sneakers from the Nike factory outlet. Mr. McLaughlin stated that he knew he was not supposed to be in the Nike store, because he had been trespassed from the store regarding an incident that had occurred earlier in the week.

I received a phone call from Officer Paul Anderson, who stated that Mr. McLaughlin had been involved in a shoplifting incident at the Nike Factory Outlet on 1/25/2016. Additionally, Officer Anderson informed me that Mr. McLaughlin had been trespassed by Nike store management during the incident.

The female was stopped and identified as YYYYY. A search of YYYYY’s bag revealed that she had taken some costume jewelry from Express Factory Outlet. YYYYY confirmed that she had taken the merchandise, and forgot to pay for it.

I advised Mr. McLaughlin that he was under arrest for two counts of Shoplifting by Concealing, and one count of Trespassing. Mr. McLaughlin was transported to the Somerville Police station by Officer Brian Pavao in prisoner transport unit 200, where he was booked in the usual manner by the Commanding Officer: Lt. Michael Mulcahy. Photographs of the merchandise were taken, and will be added digitally to this report. I confirmed with Nike store employees that the sneakers came from their store.

Respectfully submitted,

Officer Devin Schneider
