Elija JEAN Arrest

On July 7, 2015, I, Detective Michael Capasso was on duty in a Patrol capacity operating marked cruiser 874. At approximately 9:02 AM, I randomly queried Massachusetts Registration 143YZ2 via the CJISWEB on my cruiser’s laptop.
The status for the registered owner, Mr. Elija Lewis-Jean, revealed that he had a suspended driver’s license along with a default arrest warrant out of West Roxbury District Court (Docket # 1406CR001755) for two counts of possessing a class B drug. Based on this information, I conducted a motor vehicle stop at the intersection of Broadway and McGrath Highway, both public ways within the City of Somerville.

As I approached the vehicle, I was able to confirm that the registered owner was in fact the operator based on a license photo provided by the CJISWEB application. As Officer Isaacs and St. Hilaire arrived on scene, I escorted Mr. Jean-Lewis out of the vehicle and placed him in custody for operating with a suspended license and the default warrant. I conducted a pat frisk of his person and felt a bulge in his right shorts pocket (defendant was wearing shorts under a pair of pants). Based on the packages texture, and the strong odor of marijuana emanating from the area, I retrieved the package. The bag of marijuana appeared to contain an ounce (28 grams), and was later weighed in at 30 grams (preliminary weight including packaging).

On the floor of the front passenger seat of the vehicle, Officer Isaacs located an uncapped liter of Cognac Salignac. This bottle was emptied out on scene and disposed of.

Based on these facts, Mr. Jean-Lewis was issued Massachusetts Uniform Citation # R5390255 and charged with the following offenses:
1- Operating a motor vehicle with a suspended license;
2- Possess an open container of alcohol in a motor vehicle;
3- Operating a motor vehicle with a failed inspection sticker (failed on 04/17/2015);
4- Possess an ounce of marijuana, a class D substance.
