Real Life Somerville Police Stories: James MURPHY (B&E Nighttime Felony, Poss Burglarious Instrument, VCO Poss DW)

The following is a summary of the details related to this incident.

                On Wednesday, November 7, 2018, I, Officer David Ruf, was in full-uniform and assigned to marked cruiser East-2, for the Somerville Police Department. At approximately 2:54 A.M., Officer Sousa (East-3) and I were dispatched to 14 McGrath Hwy (Sally Beauty Supply Co) for a glass break alarm. Officer Messaoudi (East-1) and Officer Bork also responded as back up.

                Upon arrival Officer Sousa radioed that the front door was smashed by means of a rock. I was approaching the area on Medford Street when I observed a male riding a bike wearing a dark coat, a mask covering his face and unknown object with a dark grip and with a lighter color stripe in his coat leaving the area in close proximity of where the B & E just occurred. I immediately made a u-turn and stopped this individual, later identified as James Murphy, across from Somerville Gas next to the train tracks. I radioed my position to dispatch and exited my cruiser to speak with the individual. I observed a small hammer sticking out of his left pants pocket, for officer safety I placed James in handcuff and pat frisked his persons for any additional weapons. A small pocket knife measuring approximately 4″ was recovered from his waistband. I asked James where he was coming from tonight and he stated he was just out for a bike ride to clear his head because he couldn’t sleep. It should be noted that at booking James informed the commander that he lived in Charlestown. I asked him where he specifically was coming from, but couldn’t tell me because he was not familiar with the streets of Cambridge. I then asked James who the bike belonged to, he stated it was his little brother’s friend Jonathan, but couldn’t provide me with a last name. I asked him what the hammer was for and he stated it was used on the bike sometimes. I also asked him why he was carrying the knife and he stated it was from when he worked at UPS to cut boxes and straps.

                The manager, XXXX, of Sally Beauty arrived on scene so that we could review the cameras. In the video a person wearing a grey hat, dark coat, dark pants, mask covering the face and gray sneakers can be seen throwing a rock through the window and then jumping through the window. The suspect then went behind the counter and started to put various merchandise in store brand bags and then exit the store. The clothing that the suspect was wearing in the video matched what James had on. James was wearing a black North Face jacket that had a hood with a neck/face scarf, grey Adidas sneakers, and a grey Adidas hat.

                Officers recovered the stolen property (value $845.40) in close proximity to where James was originally stopped. All the items recovered were photographed and returned to Sally Beauty. The recovered items are as follows;

                At this time based upon the video evidence that I witnessed, James was placed under arrest for the following;

M.G.L c266 / §16A  B AND E NIGHTTIME FOR FELONY 

M.G.L c266 / §49    POSSESSION BURGLARIOUS INSTRUMENT

90/6    VCO POSSESSION OF DANGEROUS WEAPON (knife)

                James was transported by Unit #200, Officer Ramirez to Somerville Police Headquarters where he was booked by Lt. deOliveira. Under closer examination, you could see what appeared to be glass particles sparking on James’s clothing. The hat, sneakers, and coat were photographed and placed into evidence. It should also be noted that at some point James spontaneously uttered that he was going to be starting a job as a barber soon in Quincy. All the items that were stolen are consistent with what a barber would use.
