The following is a brief summary of facts pertaining to incident # 18065891.
FIREARM WITHOUT LICENSE,CARRY LOADED c269 s10N
TRESPASSING c266 s120.
On 11/05/2018 at approximately 11:45pm , Mr. HENRY ALVAREZ DOB xxxx of 26 Kensington Ave. apt #1 in the City of Somerville, did have in his possession and on his person carry a LOADED FIREARM W/O being legally licensed.
On the above date and time while on duty for my 5pm-1am shift for the Somerville Housing Police, I was making a
walking patrol of random hallways.
As I entered the rear doorway of 45B Memorial Road hallway I observed what appeared to be 2 shadows in dark clothing walking just outside of the front entrance. I took a step into the hallway and immediately saw a male known to me as HENRY ALVAREZ leaning against the wall that is next to apt #xx ( I know Henry has been TRESPASSED from all SHA properties).
As I got closer to him I clearly observed what I knew to be the butt of a firearm sticking out of his pants waistband.
Without hesitation I pinned Henry in the corner where he was standing and I snatched the firearm from the front of his
exposed waistband. I radioed to Somerville Police dispatch over my police radio to send me some help at my location of 45B Memorial Road. Henry began to flail his arms and attempted to push me away while yelling what the fuck are you doing.
I told him to turn around and put his hands behind his back as I was wrestling with him. He continued to resist while yelling what the fuck. I was able to place him into handcuffs after a brief struggle.
I again radioed to SPD dispatch to send Unit-200 and a Supervisor advising all that I had an individual with a GUN and that the suspect was in custody. Moments later several SPD units arrived to assist, officers Canty, Lorenti and Clark and SPD Sgts Moreno and Slattery.
I handed the FIREARM to officer Patrick Canty to make safe and secure while I continued my incident to arrest pat down
of Henry Alvarez. Officer Canty cleared the firearm advising me that there was 1 in the chamber (meaning the gun was loaded and ready to fire) and 3 in the magazine.
When asked if he had a license to carry the firearm Henry just stated fuck you Cops. It was later determined via
records check that he did not. While standing out front of the building the 2 individuals whom I believed to had just walked away from Henry the moment before I stepped into the hallway had come back to this location and were FIOd by the SPD officers (it was determined that they had nothing to do with this incident).
Mr. Alvarez was belligerent and rude the entire time to all officers on scene, he even spit at Sgt Moreno when he was
placed into the back of the transport vehicle narrowly missing him. Henry was transported to the Somerville Police station by SPD Unit-200 where he was booked in the usual manner.
I secured the firearm with me and transported it and the ammunition back to the SPD where it was placed into an
evidence box and secured into evidence locker #3.
The firearm was determined to be a 25 caliber model L25 LORCIN- Silver with a Pink colored handle/But bearing the
Somerville Housing Police
