

On Wednesday, August 16, 2017 while assigned to Assembly Row as Unit Alpha-3, I was contacted by Saks LP XXXXX on my department-issued cell phone. XXXXX stated that Brandon Tracy, a known shoplifter who frequents Saks was in the store and had concealed two pairs of shoes in a brown paper bag. I called this into dispatch and requested an additional unit. Unit East-1 (Officer Vannostrand) was dispatched and Sierra-8 (Lieutenant Rymill) also responded. I approached Mr. Tracy and explained to him that he had been seen concealing merchandise and that he had previously been trespassed from Saks. It is worth noting that I personally was the one to advise Mr. Tracy both times of him being trespassed from the location. Mr. Tracy was escorted back to the Loss Prevention office. Looking into the paper bag I could see a white cloth, removing it showed it to be a white neck tie that retailed for 49.99. XXXXX at this time told me that he witnessed Mr. Tracy take a pair of sneakers off the shelf, cut the anti-theft device off and put the sneakers into the paper bag. He also stated that Mr. Tracy put the sneakers back on the shelf. It was his belief Mr. Tracy did this because he believed he was being followed by store staff. A frisk of Mr. Tracy turned up nail clippers in his front left pocket, which are commonly used to remove anti-theft devices from merchandise and one Mr. Tracy has used in the past from my personal experience with him. At this time I placed Mr. Tracy in handcuffs (DL), advising Mr. Tracy he was under arrest, and requested unit 200 to transport Mr. Tracy to the Station. A search incident to arrest of Mr. Tracy turned up a small baggie of a white powdery substance that Mr. Tracy stated was heroin in the “change pocket” on the front right side of his pants. Unit 200 arrived and Mr. Tracy was transported to the Somerville Police Station by Officer Derochers and was booked by Lieutenant Digregorio in the usual manner. Mr. Tracy is being charged with possession of class a substance, shoplifting by concealment, trespassing, removal of an anti-theft removal device, and possession of an anti-theft device removal tool.
