On the morning of Thursday, August 11, 2016, I Officer Robert Pasqualino, was on duty in marked unit East-3. At approximately 11:20 AM, I was traveling south on McGrath Highway, a public way in the City of Somerville. I randomly queried Mass registration XXXXXX from the laptop located in the police vehicle. The result of the query showed the that vehicle in question, a 2008 Toyota Scion, had a failed inspection status. It was at this time I, activated my emergency blue lights to stop the vehicle. The operator disregarded the blue lights and siren, and kept advancing forward. At this point I radioed into Somerville control to update them on the status of the stop. The driver of the vehicle, later identified as Yoni Rodriguez repeatedly stuck his arm out of the driver side window and began waving me off.
The vehicle sped up to the intersection of Linden Street and Somerville Avenue. When he reached Linden Street the operator attempted to turn left, but could not do so because I had pulled my cruiser in front of the street blocking the entrance. Mr. Rodriguez then proceeded to the next available street, being Allen Street. After multiple verbal commands using the vehicle’s outside speaker system, Mr. Rodriguez stopped the vehicle in front of 21 Allen Street.
Immediately upon stopping the car, the driver side door opened and the operator began to exit the vehicle. I drew my department issue firearm, and ordered the operator to remain in the vehicle. By this point Captain Michael Cabral, Officer Eduardo Soares, and Detective James Slattery arrived on scene to assist. After a check of Mr. Rodriguez’s license status, it revealed that he does not possess a Massachusetts drivers license.
Mr. Rodriguez was placed in to custody by Officer Eduardo Soares, and Unit #200 was requested to transport Mr. Rodriguez to the Somerville Police Station to be booked by the shift commander Lt. Diogo DeOliveria. Mr. Rodriguez will be charged with C/90 S10 Unlicensed operation of a motor vehicle, C/90 S/25 failure to stop, and C/90 S/20/B fail to inspect a motor vehicle.
