Real Life Somerville Police Stories:Brian DALEY ARREST (Malicious Defacement of Property/Attempt to Commit Crime)

BRIAN MICHAEL DALEY Arrest
On Tuesday, 9/22/2015, I, Officer DiFava, was on duty for the Somerville Police operating marked cruiser 876. At approximately 1259 hrs, I was dispatched to Walker Street for a report of an attempted break. Officer Martini and Officer Pavao also responded to provide back up. Upon arrival, I was greeted by the reporting party, XXXXX. According to XXXXX, she heard the door bell ring and when she looked out the window to see who it was, she observed a man, later identified as Brian Daley standing on her front porch. XXXXX did not want to answer the door and stated that Daley continued to ring the door bell several more times. XXXXX stated that after the door bell stopped ringing, she heard what sounded to her like a screen being torn coming from her front porch area. XXXXX opened her front door to see where the noise was coming from and observed Daley in the corner of the porch standing in front of an open window. It should be noted that Daley was the only person XXXXX observed on her porch. Daley immediately came over to her and asked her if she needed any help with her yard work. XXXXX stated that she did not own the house and that she did not need any help. Daley left the porch and walked up Walker Street taking a right onto Leonard Street. XXXXX stated that she left the window open, but that the damage to the screen was new. XXXXX described Daley as wearing a black t-shirt, blue jeans, sneakers, frosted hair and was wearing a backpack.

While speaking with XXXXX, Officer Thomas Burdulis of the Tufts University Campus Police Department arrived to gather a description of Daley. After obtaining Daley’s description, Officer Burdulis left. At this time, I requested Sgt Deoliveira to take a picture of the damaged window screen.

At approximately 1330 hrs, Officer Moreira who was in his personal motor vehicle observed Officer Burdulis speaking with Daley at the corner of Bromfield Road and Warner Street. Officer Moreira had been working an assignment detail in the area and was in full uniform. Officer Moreira advised dispatch that he was out with a suspicious male that matched the description provided by XXXXX.

I explained the show-up form to XXXXX and placed her in the backseat of my cruiser. I drove over to the intersection of Bromfield Road and Warner Street where XXXXX was able to make a positive identification.

Daley was placed in handcuffs and transported to the Somerville Police Department where he was booked by Lt. Lavey.

I spoke to Officer Burdulis, who stated that he was driving his cruiser on Bromfield Road when a male, later identified as YYYYY ran up to him. YYYYY stated that Daley had been on his front porch ringing his door bell twice within the past 15 minutes. At this time, Officer Burdulis backed his cruiser up and stopped Daley.

Respectfully submitted,

Officer Marc DiFava
