On 09/02/2015 at approximately 4:16 PM, I, Officer Albert Gee assigned to Alpha 1 received a phone call on my department issued cell phone from Saks Loss Prevention Manager XXXXX. He stated he was going to apprehend 2 white males, one wearing a black T shirt with a black hat and facial hair later identified to me as Mr. Jordan Alves, and the other male had short brown hair and a white T Shirt later identified to me as YYYYY Officer Devin Schneider assigned to East 4 and Officer Tim Van Nostrand assigned to East 1 arrived as back up.
He stated that he observed the two males enter the store and select 15 items valued at $869.52. The items consisted of men’s clothing items, sunglasses and a black Michael Kors handbag. They then walked to the register operated by Ms. Tracie Calder.
XXXXX stated when she picked up a pair of sunglasses and put them in a sunglasses case, and she only scanned the case and not the sunglasses and put the items in a Saks bag, he knew that she was going to pass off or not charge him for the merchandise. Ms. Calder then put the rest of the merchandise in a few Saks bags and handed them to Mr. Alves and YYYYY along with two Saks bags she filled with children’s, women’s, and jewelry she staged earlier in the day. The bags Ms. Calder filled consisted of women’s and children’s clothing and jewelry. There was 25 items in the bags and the total value was $760.48.
The men exited the Saks sunglasses door where they were apprehended by Officer Schneider and myself. They were escorted to the Loss Prevention office and the merchandise was recovered. I contacted Somerville control and they stated they had 3 warrants for Mr. Alves.
I asked Mr. Alves if he had a receipt for the items and he presented me a receipt with a sunglasses case and a T shirt on it totaling $15.10. I asked him does it sound reasonable that he only spends that little amount and leaves the store with over a thousand dollars worth of clothing. He said he thought he was getting a good deal. I also asked him about the women’s clothing and jewelry and he didn’t answer.
I asked YYYYY what items were for him and he said he was just holding the bags for Mr. Alves. Mr. Alves interjected and said all the items they selected was for him.
I placed Mr. Alves under arrest for the warrants, Larceny over $250.00 by false pretense, and conspiracy, he was handcuffed, and transported to the station and booked in the usual manner.
Ms. Calder was placed under arrest for Larceny over $250.00 by false pretense, conspiracy, she was handcuffed, transported to the station and booked in the usual manner by Lt. Mulcahy.
