Real Life Somerville Police Stories: Shawn SMITH (Firearm Charges, Narcotics Charges, Aggravated A&B, Intimidation) & Henry AUGUSTINE (Firearm Charges, Narcotics Charges)


On Monday, July 15, 2019 I was assigned the Bravo unit along with Officer Brian Pavao. At 7:25 P.M., Somerville Police control received a call from a male stating that he was threatened by three males sitting in a gray two door car in front of the church, located at XXX Temple Street. The reporting party stated to the call taker that one of the suspects is wearing white sneakers, shorts and no shirt; he is known to carry a gun and made threats to kill him. The reporting party stated that the suspect is known to him as “Piffy” and officers should be familiar with him. Piffy is Shawn SMITH’s nickname.

Detective Mark Pulli advised responding units that the reporting party is a victim of an assault that occurred on 07/12/2019 (incident# 19039521) where the victim was assaulted and threatened with a handgun. Based on this information it appeared that this call was directly related to the previous assault.

We searched Temple Street, then Butler Drive (the back side of the church), where we located a gray Honda Accord Coupe bearing Massachusetts registration XXXX occupied by three males. It should be noted that this vehicle was the only gray two door sedan on that street. The front passenger with no shirt on was immediately identified as Shawn SMITH, matching the description given by the reporting party. SMITH is known to Somerville Police officers from previous encounters to include firearm violations. On scene, detective Pulli advised that SMITH was one of the suspects in incident 19039521 and there was probable cause to arrest him for that incident.

We identified the driver/owner of the vehicle as Henry AUGUSTINE, and the rear passenger as XXXX. We removed the three males from the vehicle, conducted a pat frisk of them and the areas in the vehicle where they have, had, or will have immediate access to a weapon.

During the pat frisk of the vehicle, I observed the glove compartment to be locked. I utilized the ignition key obtained from AUGUSTINE and opened the glove compartment where I located a soft black neoprene pouch. I felt a hard object consistent with the shape and size of a weapon. I then opened the pouch and found a silver handgun (Ruger Mark II .22 Cal) with four rounds in the magazine and 2 loose rounds along with a small bed sheet.

Officer Canty conducted a search incident to arrest and located 13 rounds, five baggies of marijuana, one bag containing crack cocaine, several empty bags, and a scale.

I located a small zip lock bag containing marijuana in AUGUSTINE’s right shorts’ pocket and $406 cash in his left pocket which was seized.

AUGUSTINE was charged with:
Carrying a firearm with ammunition c.269 S10N
Carrying a firearm without license c.269 S10
Possession of ammunition without FID card c.269 S10(H)
Possession to distribute class D c.94C S32C
Possession of class B c. 94C S34

SMITH was charged with:
Aggravated assault and battery c. 265 S13A
Intimidation of witness c.268 S13
Carrying a firearm with ammunition c.269 S10N
Carrying a firearm without license c.269 S10
Possession of ammunition without FID card c.269 S10(H)
Possession to distribute class D c.94C S32C
Possession of class B c. 94C S34

AUGUSTINE and SMITH were transported to the Somerville Police headquarters via unit 200, operated by Officer Reece and booked by Sergeant Holland.

Officer Pavao tagged all items seized/confiscated and placed them into evidence. The vehicle was towed from the scene by Pats tow.
