

The following is a summary of the details related to this incident.
On Sunday, October 1, 2017, I, Officer David Ruf, was in full-uniform and assigned to marked cruiser East-1, for the Somerville Police Department. At approximately 1:01 A.M., I, along with Officer O’Brien (East-4), was dispatched to XX MacArthur Street for an unwanted. Upon my arrival I was met by the reporting party, XXXXX hereinafter referred to as “Juvenile 1”, YYYYY and ZZZZZ.
I spoke with YYYYY who appeared to be shaken and visibly upset stated that she saw defendant, Nicholas STILES, in her room with what appeared to be a flashlight. He then left her room and went upstairs. STILES then came back down and YYYYY stated that STILES pushed her in the hallway against the wall and stated “where is my fucking coat.”
I then spoke with Juvenile 1 who was visibly upset. She stated that she was asleep and woke up to STILES shaking her and asking about his jacket. Juvenile 1 then stated that STILES started going through her draws while she was screaming at him to get out. Juvenile 1 stated that when STILES left her room she ran outside and saw STILES punch her brother, ZZZZZ. I then spoke to AAAAA hereinafter referred to as “Juvenile 2”. She stated that she was in the room with Juvenile 1 and STILES barged in asking about his jacket. Juvenile 2 stated that he looked through the draws and then left the room.
I also spoke to a male and female, later identified as BBBBB and CCCCC, who were in the house. BBBBB stated that he was in his room playing XBox and STILES opened the door and asked about his jacket. He then stated that STILES came in the room and stated if he can’t find it, someone has to pay the consequences. CCCCC stated that she was in BBBBB’s room sleeping and STILES came in the room yelling about his jacket. She said that STILES stated he doesn’t want to hurt someone, but if he doesn’t find it someone has to pay the consequences. CCCCC then stated that after STILES left she could hear glass break.
I then spoke with ZZZZZ who was bleeding from his mouth and had minor cuts to his hand, he refused medical treatment. ZZZZZ stated that he was sleeping on a couch in the garage when he was punched in the face and woke up to STILES above him. ZZZZZ stated that STILES grabbed him by his hand and dragged him out of the garage towards the house. ZZZZZ also stated that STILES destroyed several glass cups, destroyed a piece of furniture, and other items that were in the garage. ZZZZZ stated that STILES left the scene to go back to Casey’s Bar, located around the corner on Broadway.
Other responding units, Officer Beckford (East-3) and Officer Slattery (East-2), located STILES. I then responded to Casey’s to speak with STILES. Upon my arrival, I read STILES his Miranda Warning from a card I keep on my persons. STILES stated he understood and wished to speak to a lawyer. At this time based upon off statements that I received and my visual observations, I placed STILES under arrest for the following; M.G.L c265 / §13A A & B three counts, M.G.L c266 / §17 Enter at night, person in fear, M.G.L c266 / §127 Malicious destruction of property -$250. He was transported to the Somerville Police Headquarters via unit 200, operated by Officer Radochia, and booked by Lt. Rymill.
It should be noted that while awaiting transport and after STILES invoked his right to remain silent he attempted to speak. He was advised several times from Sergeant Perrone and myself that he invoked his right to remain silent and that anything he said would be used against him. STILES continued to attempt to speak and uttered that he needed a place to stay anyways, that the kid couldn’t handle a scrape, and they stole my jacket.
