Real Life Somerville Police Stories:Seanna GARCIA (Trespass, Disorderly, Resisting Arrest)


 

On June 4, 2017, I, Officer Tim Van Nostrand, was on duty and assigned to uniform patrol in marked cruiser East 1. At approximately 9:24pm, I was dispatched along with Officer Chris Collette (East 4) to the AMC Movie Theater for two unwanted customers. Officer Brian Pavao (East 2) and Sgt. Michael Holland (S8) also responded.

 

Upon arrival I was approached by a female, later identified as Seanna Garcia. Garcia began to explain that she and her friend were asked to leave the theater, and demanded the Somerville Police review security footage inside the theater. Garcia had a difficult time explaining the situation due to her level of intoxication. Garcia was slurring her words, had glassy eyes, and I could detect an odor of an alcoholic beverage emanating from her breath.

 

The manager of AMC, XXXXX, stated they asked the two females to leave approximately ten separate times due to their level of intoxication and disorderly behavior inside the theater. XXXXX also stated the consumed alcohol that they had smuggled in. Other AMC personnel and AMC security corroborated the requests to leave the property. I then advised Garcia she needed to leave the property immediately per management. Garcia was provided a business card of AMC management in order to file a complaint with the theater. Garcia continued to refuse to leave the property. I issued Garcia one final warning, and then attempted to escort Garcia from the property. Garcia pulled away from myself and Officer Pavao, and began flailing, creating a scene. Numerous guests stopped to observe the disturbance, and business was interrupted at the theater.

 

We continued our attempt to escort her from the property, however due to her violent behavior Officer Collette placed her into handcuffs. While being escorted out, Garcia continuously pulled away from us and dug her fingernails into officers’ skin in an attempt to free herself from custody. She also thrashed about as we walked and loudly stated this was “brutality”, in an apparent effort to garner support from the public.

 

Garcia was transported by Officer Desrochers in unit 200, where she was booked by LT. DiGregorio. Garcia is being charged with Disorderly Conduct (272/53), Trespassing (266/120), and Resisting Arrest (268/32B).
