Real Life Somerville Police Stories:Joao BAIROS (Suspended License OUI, Reg Revoked Op MV)

On April 20, 2017, I, Officer Tim Van Nostrand, was on duty and assigned to uniform patrol in marked cruiser East 1. At approximately 2:40pm, I randomly queried MA XXXXX on Broadway. The result of my query informed me that the registration for the vehicle was revoked due to lack of insurance.

 

I activated my emergency equipment and stopped the vehicle on the corner of Indiana Ave and Broadway, both public ways in the city of Somerville. The operator verbally identified himself as Joao Bairos, the registered owner. I requested a Portuguese speaking officer due to the fact that Bairos was having difficulty communicating in English. Detective Mike Faria arrived and confirmed that the individual identified himself as the registered owner, Joao Bairos. I confirmed through the registry that Bairos’ right to operate in Massachusetts was suspended. On March 4, 2017, Bairos was arrested for operating under the influence of alcohol in Cambridge, and refused the chemical test resulting in a license suspension for 180 days. Bairos confirmed he knew his license was suspended.

 

I ordered Bairos out of the vehicle and placed him under arrest (double locked handcuffs) for Operating after suspension for OUI (90/23/f) and Operating after revocation of registration (90/23/H/A). Bairos was transported to the station by Officer Desrochers in unit 200, where he was booked by Lt. deOliveira and Sgt. Monte. Pat’s Tow responded and towed the vehicle. I seized both plates and issued Bairos citation #R8323074.
