

The following is a brief summary pertaining to Incident #16048110:
On Friday, August 5, 2016, I was assigned to the Somerville Police Drug Control Unit. Routine surveillance was set up in the area of the Otis Street Playground by me and detectives Brioso, Collette, Costa, and Legros were also in this area. This surveillance was initiated as a result of numerous complaints of possible drug activity within the park and surrounding area. At approximately 5:30 P.M. a gray Honda Civic parked at the corner of Dana Street and Otis Street. I randomly queried this registration via my laptop and found the vehicle to be active to Starling Pichardo out of 20 River Road, Somerville, MA 02145. As I queried Mr. Pichardo’s board of probation I noticed he was listed as having a criminal record under the name Stanley Pichardo, with an address of 56 Otis Street, Somerville, MA 02145. I noticed the lone male operator appeared to be Mr. Pichardo through a license photo. In addition, he was also identified by Detective Costa who had prior dealings with Mr. Pichardo.
Mr. Pichardo was seen speaking to someone on his cellular phone within a few minutes of parking his vehicle. As Mr. Pichardo got off the phone, he quickly walked into the residence using a key to enter the lone front door. Within a couple minutes, Mr. Pichardo exited the residence and got back into the gray Honda Civic. As he entered the Honda Civic I could see Mr. Pichardo using the phone again speaking with someone for approximately a minute. Mr. Pichardo then began to drive away heading down Otis Street towards Wigglesworth. A constant rolling surveillance was kept of Mr. Pichardo as he took a right onto Pearl Street, right onto Medford Street, right onto Sycamore Street, and left onto Forster Street where he parked his vehicle on the corner of Sycamore and Forster Street. As the gray Honda was now parked, Mr. Pichardo exited the vehicle and began walking towards the Winter Hill Community School. Detective Legros stated that Mr. Pichardo was raising his arms in order to gain the attention of a blue Jeep Liberty. The blue Jeep Liberty stopped at the corner of Evergreen and Sycamore Street as Mr. Pichardo got into the passenger side of the vehicle. The blue Jeep then took a left turn onto Forster Street, left on Tennyson Street, and stopped halfway down Tennyson. As the vehicle pulled over to the right hand side of the street, Mr. Pichardo exited the blue Jeep and began to walk up Tennyson Street towards Forster Street where he would then turn right, going back to where he parked his vehicle. Mr. Pichardo’s short trip in the blue Jeep is known as the “meaningless ride.” In my training and experience, I believed Mr. Pichardo and the operator, later identified as the owner, XXXXX, of the blue Jeep had just been involved in a street level drug transaction.
At this time, Detectives Brioso, Costa, and Collette stopped XXXXX on Tennyson Street as Detective Legros and I stopped Mr. Pichardo on Forster Street as he attempted to drive down Forster towards Tennyson. As we approached Mr. Pichardo, with our badges clearly displayed on our outermost garment, I asked Mr. Pichardo to put the car in park and show me his hands. Mr. Pichardo immediately put the gray Honda in park and put his hands up. I could see Mr. Pichardo clenching what appeared to be multiple new hundred dollar bills in his left hand. As I asked Mr. Pichardo to show me what was in his hands he stated, “It’s just some money I got.” It was found that Mr. Pichardo was holding six hundred dollars in US currency. The money contained six, one hundred dollar bills. During this same time, Detective Costa stated that the operator of the blue Jeep, XXXXX, had a small glassine baggie in plain view at his center console. This glassine baggie contained twenty small blue pills inscribed with “A-51.” These pills are believed to be Percocet 30 mg pills, a class B controlled substance. Mr. Pichardo’s six hundred dollars is consistent with the twenty 30 mg pills sold to XXXXX.
While speaking to XXXXX, Detective Costa read him his rights pursuant to Miranda from a card he keeps. XXXXX stated that he met Mr. Pichardo to purchase twenty Percocet 30 mg in exchange for six hundred dollars. XXXXX stated that he has purchased Percocet 30 mg pills from Pichardo multiple times in the past. XXXXX also stated that Pichardo usually meets relatively quickly compared to other drug dealers. XXXXX stated that Mr. Pichardo must be living in Somerville because he usually only take about twenty minutes to deliver Percocet on a normal day.
While speaking to XXXXX, he apologized for buying the Percocet 30 mg pills and stated he was an addict of Percocet. XXXXX agreed to sign a Somerville Police Voluntary statement form in which he admitted to purchasing Percocet from Pichardo in the past as well as this date. XXXXX also wrote that Pichardo called him from xxx-xxx-xxxx. I called this number from a work phone and found it to belong to the cellular phone which was found on Pichardo’s person during the arrest. XXXXX then stated he would sign a consent to search form for his Iphone 6S. XXXXX signed the form and Sergeant Whalen digitally downloaded the phone. During this search, it was found that XXXXX and Mr. Pichardo spoke three times this day. The times of the calls were: 5:41 P.M. for approximately one minute, 5:45 P.M. for approximately nineteen seconds, and 5:46 P.M. for approximately twenty-five seconds. I would note that these calls were consistent with the times when Mr. Pichardo parked his vehicle at his residence located at 56 Otis Street and went inside. The other calls are consistent to when Mr. Pichardo left the residence and met XXXXX to distribute the Percocet 30 mg pills.
Mr. Pichardo was transported to Somerville Police Headquarters via marked unit 200, Officer Diaz, where he was booked in the usual manner by Lieutenant A. Rymill. Before his transport, Detective Legros pointed out the large amount of money Mr. Pichardo had on his person. I would like to note that this money was folded in multiple stacks and appeared to be over one thousand dollars in US Currency. It was found that Mr. Pichardo had $1,613.00 in US currency which was folded in approximately eight to ten stacks.
A tow for Mr. Pichardo’s gray Honda was authorized by Sergeant Whalen. This vehicle was towed to the Somerville Police Garage via Pat’s Tow as I followed directly behind it the entire way. Mr. Pichardo’s cellular phone, monies, and vehicle will be held for forfeiture proceedings. I would like to note that the area where Mr. Pichardo and XXXXX met for their drug transaction, was at the corner of Forster Street and Sycamore Street. This location is within three hundred feet of the Winter Hill Community School which is maintained by the City of Somerville.
