On 06/30/2016 at approximately 03:51 PM, I, Officer Albert Gee assigned to West 6 and Officer Yvon Jean-Jacques assigned to West 7 was dispatched to 29 Dearborn Rd. for a man masturbating in his car. Dispatch stated Tufts Police has the vehicle stopped.
Upon arrival I saw a white BMW M3 occupied by a male party later identified to me as Omar Abdala and Tufts Sgt. Mark Roche and Tufts Officer Moses Curry. I approached Sgt. Roche and I asked him what happened.
He stated that Tufts Police received a phone call from XXXXX stating that he received a text from his friend YYYYY. She told him that there was a man in a white car parked for half an hour by the Tufts Athletic Field. He would look at her and her friend, ZZZZZ while they were sun bathing on the field. When they looked at him, they would make eye contact, then he would avert his eyes and look down. This made her nervous so she texted him so he can see what he’s doing. He walked out of his home, crossed the street to the even side, and walked to the driver side door of the white BMW. He saw an Indian looking man around 5’10” with his hand on his exposed penis masturbating. He said that he didn’t notice him at first so he went to the back of the car and got the plate number then the car took off. The vehicle then sped off and he called Tufts Police to report a Indian man was masturbating in a white BMW.
Sgt. Roche searched the area and saw a white BMW on Warner St and it took a quick turn on to Bromfield an accelerated at a high speed down the street. He activated his emergency lights and sirens and pulled the car over. He approached the vehicle and saw a man with his shirt un-tucked and his zipper was half way down on his jeans.
I approached the vehicle and I spoke with the operator, Mr. Abdala. I asked him if he knows why the officers stopped him and he said, “No”. I asked him what he was doing in Somerville and he said he was passing through. He said he came from Medford and was heading home in Cambridge. I told him he was being accused of masturbating in his car by Tufts and he said, “It’s not me.”
Officer Yvon Jean-Jacques along with Tufts Office Keene Allen was speaking with the witness, XXXXX. I informed Officer Jean-Jacques that we will be performing a show up with the witness. Officer Jean-Jacques read XXXXX his Witness Show Up Form advisements from a card he keeps in his shirt pocket. I asked Mr. Abdala to exit his vehicle and stand on the sidewalk. He was un-cuffed and Tufts Officer Curry and myself stood around 12 feet away. Tufts Officer Allen drove Office Jean-Jacques and XXXXX eastbound on Dearborn Rd. Officer Jean-Jacques called my cell phone and said that he was very sure and he has the same hair, skin color, same shirt, and same car as the man that was masturbating.
I placed Mr. Abdala under arrest for Open and Gross, C272 S16 and I handcuffed him and double locked it. I requested the prisoner transport but they were conducting another booking. I received approval by Sgt. Kennelly for Tufts to transport Mr. Abdala to the Somerville Police Station. Officer Allen transported Mr. Abdala to the station and I followed in my marked cruiser. He was booked in the usual manner by Lt. Rymill.
