Real Life Somerville Police Stories:Felix DIAZ (Shoplifting, Trespass)at Big KMart Assembly Row 


On June 17th, 2016, I, Officer Devin Schneider, was in full uniform and assigned to marked cruiser East-4 during the day shift. The following report is a summary of events that I witnessed, as they pertain to incident #16036137:

 

At approximately 10:56 am, I was dispatched to Kmart, located at 77 Middlesex Avenue, for a report of a shoplifter. I arrived a short time later along with Officer Eddie Soares (East-2) and met with the reporting party, Kmart Loss Prevention detective XXXXX. XXXXX introduced me to the male suspect in the loss prevention office, who was identified as Felix Diaz via his MA state ID.

 

The following narrative is a summary of XXXXX’s statements to me:

 

XXXXX observed Mr. Diaz enter the electronics department and select several electronic items via the store’s closed circuit camera system. Mr. Diaz concealed the merchandise in his black duffel bag. Mr. Diaz then exited the store, making no attempt to pay for the merchandise. XXXXX stopped Mr. Diaz outside the store entrance, and escorted Mr. Diaz back to the loss prevention office where he recovered the following items belonging to Kmart:

 

-1 PNY 16 Gb Micro SD card $17.99

-1 PNY 32 Gb USB memory stick $24.99

-3 Skullcandy Smokin’ Buds Ear bud head phones $29.99 each

Total Value: $132.95

 

XXXXX further stated that according to Kmart’s internal record system, Mr. Diaz had been issued a trespass notice not to go on Kmart property when he had been stopped for shoplifting on 6/15/2016 at Kmart’s sister store, the Sears in Cambridge. Both Sears and Kmart are owned by Sears Holding Company.

 

I placed Mr. Diaz under arrest, handcuffing him in a manner consistent with my training and double locking the handcuffs. Per order of the Commanding Officer, Lt. Michael Mulcahy, I transported XXXXX back to the Somerville Police station in my cruiser, with Officer Soares following me in his cruiser. At the station, Mr. Diaz was booked in the usual manner by Lt. Mulcahy.

 

XXXXX stated that he will be able to make a copy of the video available at a later date. A query of Mr. Felix’s Board of Probation record shows that Mr. Diaz has 5 previous guilty findings for shoplifting. I will be seeking the following charges against Mr. Diaz

 

-Ch. 266 / S. 30A: Shoplifting by Concealing Merchandise, 3rd Subsequent Offense

-Ch. 266 / S. 120: Trespass
