Real Life Somerville Police Stories:Disorderly/Possession of Open Container Arrest

   
 
RICHARD J MASON Arrest

On Thursday, August 06, 2015 I was assigned to marked unit East-1. At 12:40 A.M., I conducted a directed patrol in the Cobble Hill apartments and plaza located at 50 Washington Street. 

While checking the rear of the buildings on New Washington Street, I observed a male later identified as Mr. Richard Mason lying down on the grass outside the building. As I approached Mr. Mason, I observed one open container (Natural Ice 25 oz), three empty beer cans and one empty bottle (Rubble Vodka 200 ml).

 

Mr. Mason stated to me “what the fuck do you want?” I asked him to pick up all the trash and leave. Mr. Mason replied “Let me tell you something, next time you see me, you better leave me the fuck alone. I’m not leaving” I informed Mr. Mason that he is in violation of the city ordinance (Possession of Open Container).

 

Officer D’Amelio and Officer Diaz responded to the scene. Mr. Mason was given another chance to pick up his belongings, clean up, and leave. He refused to comply, became loud and aggressive towards officers and started shouting profanities. Mr. Mason was unsteady on his feet and had a strong odor of alcohol on his breath.

 

I informed Mr. Mason that he was being charged with possession of open container and disorderly conduct and asked him to put his hands behind his back. Mr. Mason refused to comply, raised his arms and took a fighting stance. I grabbed his arm and he pulled away from me. Officer D’Amelio grabbed his left arm, I grabbed his right arm and we assisted him to the ground. With the help of Officer Diaz and D’Amelio, I was able to place Mr. Mason in handcuffs.

 

Mr. Mason complained of pain in his right leg. Officer Diaz requested an ambulance, and when Cataldo ambulance arrived on scene, Mr. Mason refused medical attention and called the EMTs “idiots” and “losers.”

 

Mr. Mason was transported to the Somerville Police Headquarters via unit 200, operated by Officer Melo. At the station, Mr. Mason refused to walk from the wagon to the booking window and refused to comply with the booking process.
