Somerville/Medford News Weekly Speakup Line:Current Administration Conspired With Previous Administration On Severability Clauses For Their Own Personal Gain

Dear Billy T and Somerville/Medford News Weekly Speakup Line,

Everybody in Somerville should know about and be aware of that they have been sold out on the Secondary Market. They deserve to know this answer. This clause was created by your former mayor who conspired with your current mayor to make it easier for them on their development projects for their own personal gain.

Concerns to this issue has been brought up by many financial lenders many times to that severability clause of the purchase and sales, and they’ve been told many times how to fix the issue, but they refuse to fix the issue knowing that they would have to go back and reclose all the previous closings that have taken place In Somerville.

A severability clause in a contract states that its terms are independent of one another so that the rest of the contract will remain in force should a court declare one or more of its provisions void or unenforceable.

What is a severability clause example?:

If any provision of this Agreement is held to be illegal or invalid for any reason, the illegality or invalidity shall not affect the remaining provisions hereof, but such provision shall be fully severable and this Agreement shall be construed and enforced as if the illegal or invalid provision had never been included …

There is a severability clause on all purchase and sales agreement that say, if you see an issue, it should get fixed. I brought this up to the attorneys that were representing the developer and they would not fix it, saying that if they fix this one that hast to fix all the ones that they’ve ever done and they weren’t willing to do it.
