On October 10, 2018, I, Officer Tim Van Nostrand, was on duty, and assigned to uniform patrol in marked cruiser East 1. At approximately 9:01pm, I was dispatched, along with Officer Erik Ubeda (East 3) and Officer Doug Brioso (East 2), to 8x Broadway for a fight. Upon arrival, I was directed to Franklin St by numerous witnesses. I observed in the street in front of x Franklin St, a Hispanic male with no shirt and a hat on squared up to fight a white male with no shirt on. The white male appeared to be back peddling as the Hispanic male was advancing on him with his fists clenched, and his right fist cocked behind his body as if a strike was imminent. A third male was walking away from the altercation, putting his shirt on. I ordered all three males to sit down, to which they complied.
At this time, I recognized the Hispanic male to be Adam Rodriguez, a documented MS13 gang member who is well known to the Somerville Police Department. Witnesses on scene stated Rodriguez exited his red Dodge Ram pickup (MA xxxx) and attempted to start an unprovoked fight. While speaking with Rodriguez, I detected a strong odor of alcohol emanating from his breath, and his speech was extremely slurred. Earlier in the night, I responded to 78 Broadway for an injured person (Incident #18060486), who did not want police involvement, but reported the operator of a red pickup truck with a ladder on it, exited his vehicle and struck him with provocation. Rodriguez’s truck is red and had a ladder on the driver’s side.
I placed Rodriguez under arrest for disorderly conduct, and he was transported by Officer DiFava in the prisoner transport vehicle to the Somerville Police Station, where he was booked by Lt. DiGregorio.
