Real Life Somerville Police Stories:Suspended Operation of a Motor Vehicle

   
 
On December 16, 2015 at approximately 1707 I was in full uniform and assigned to the Somerville Police Traffic Bureau. I observed a 2005 Toyota Scion color grey, traveling east on Medford Street towards McGrath Highway (Rte 28), both public ways within the City of Somerville. The Traffic control signal had changed to yellow, and though the vehicle had plenty of time to stop, it appeared to slightly increase its speed toward the intersection and I observed the signal turn red and the vehicle go through the solid red light. I activated lights and siren stopping the vehicle on McGrath Highway (S) down ramp near Somerville Avenue. I approached the operator, the defendant in this matter, and requested his license and registration. The defendant stated he did not have his license with him but did hand me the registration. I requested the defendants name and information and the defendant stated his name was Christian Omalley. I asked the defendant if he knew why he was being stopped and he stated “a yellow light ?”. Giving him all benefit of doubt I simply stated “yes, a yellow light”.

I returned to my cruiser and queried the defendants information and when I got no record I informed dispatch who sent an additional unit. I returned to the vehicle and asked the defendant how old he was and he replied “Seventeen”. Though he appeared to be a little older I requested he repeat his information and he did so. I then asked for a Social Security number and he stated he did not know it. I had the defendant shut the car off and hand me the keys, which I placed on the roof of the vehicle. I returned to the vehicle and not only queried it myself but had dispatch do so also. Officer Doug Brioso arrived on scene in an unmarked vehicle and I stated briefly what I had, and also that if I could get a valid name I could avoid the arrest.

Myself and Officer Brioso approached and spoke with the defendant who stated “I’m going to jail anyway”, and we inquired why ? Do you have warrants ? The defendant did not answer but did give us his true name finally after stating “if I cannot prove who you are, you will go to Jail”. I queried the defendant along with dispatch and learned he had a Non-Bailable outstanding warrant, and a Revoked Operators License as reflected on the records of the Registry of Motor Vehicles.

        The defendant was placed into custody, issued Citation # R6636476, and the vehicle towed to Pats Tow. The defendant was transported to the Somerville Police Station for booking by Lt. Mulcahy, the Division Commander.
