Real Life Somerville Police Stories:Donald FROST (Malicious Defacement of Property, Resisting Arrest, Shoplifting, Poss. of Dangerous Weapon)

On 12/16/15 at approximately 11:47am while working in marked unit East-3, I was dispatched to 180 Somerville Avenue-Target for a man who was in the process of shoplifting. East-2 Ofc. Canty and East-1 Ofc. Messaoudi responded as backup.

Upon arrival, we were unable to make contact with the reporting party before staff had him contact me on my personal cell phone. The reporting party, later identified as XXXXX called my personal phone and stated he was with loss prevention for Target and that he had been following a man around for approximately 4 hours while he concealed merchandise on him. He stated that he called us before he approached the man because the man appeared to be agitated and had smashed his shopping cart into others during the 4 hours he had been in the store. He was concerned that the man may become violent when he stopped him. XXXXX asked us to wait outside and that he would make contact as soon as the man left the store with the stolen merchandise. A few minutes later XXXXX called back and said that the man had just paid for only a few of the items, however he believed that there were additional concealed items on his persons and was on his way out the front door.

The man then came out the front door who would later be identified as the defendant Mr. Donald Frost. I pulled my marked cruiser up to the front door as XXXXX stopped Mr. Frost at the front entrance and asked him to come back inside. As Mr. Frost turned to go back inside I noticed that he had a folding knife hanging out of one of his front pockets. I asked Mr. Frost to stop, while doing so I took the folding knife from him and asked if he had any other knives or weapons on him. Mr. Frost responded that he did not and I gave him a brief pat down. I would like to note that Mr. Frost had multiple layers of clothing on along with other concealed items. I told Mr. Frost that I would give him a better pat down as soon as we got into the loss prevention office. On the way into the office, Mr. Frost became extremely agitated and screamed in excess. Mr. Frost then punched a hole through the wall inside the store, just beyond the cash registers using his fist. Due to Mr. Frost’s violent outburst in addition to the discovery of a folding knife, I immediately grabbed Mr. Frost and told him to get on the ground. When Mr. Frost refused to go down to the ground on his own, I helped guide him to the ground inside of Target. I told him to put his hands behind his back which he refused to do. As Ofc. Canty, Ofc. Messaoudi and I tried to place Mr. Frost in handcuffs he tried to kick me and refused to put his hands behind his back. I advised Mr. Frost that if he did not cooperate he would be sprayed with OC spray. Mr. Frost refused to comply and I gave him a quick short burst of OC spray to the side of his face. Mr. Frost was eventually subdued and placed into handcuffs. He stated something along the lines of- you’re lucky that I am in handcuffs because you fight like b****** and I would f*** you up. Mr. Frost was advised to calm down by Ofc. Canty, eventually we were able to stand him up and recover stolen merchandise that he had left the store with. He had merchandise in his pockets, up his pant legs as well as well as inside his jacket. A receipt(1506174-2) was printed out of what we took off of him and will be put into evidence along with the knife(15061740-1) he was carrying.

Mr. Frost was transported back to the station by Ofc. D’Amelio in marked unit 200 and booked in the usual manner by Lt. Lavey. I would like to note that Mr. Frost was not cooperative during transport as it took two officers to escort him to unit 200 from Target. Once he was in unit 200 he began to kick the doors to the unit. Mr. Frost was charged with Ch266/S30A Shoplifting By Asportation, Ch266/126A Defacement Wanton Property, Ch266/32B Resisting Arrest, CSO9/96 VCO Possession of Dangerous Weapon.

Respectfully submitted,
