Real Life Somerville Police Stories:OUI Arrest 

   
 
On November 22, 2015, at approximately 22:55 hours, while patrolling ward 2, Officer Soares and I, came across a three vehicle accident at 588 Somerville Avenue, which is a public way. Two of the vehicles were blocking traffic on Somerville Avenue, while the third vehicle was parked on the side of the road. One operator, identified as XXXXX, provided me with a passport, and the operator of MA 3KR648, identified as Adriana SIMOES, stated that she does not have a driver’s license. The owner of the third vehicle was not present. While interviewing XXXXX, he stated he was traveling westbound on Somerville Avenue. SIMOES took a wide right turn out of Garden Court onto the eastbound lane of Somerville Avenue, when she crossed the double yellow lines and struck XXXXX’s vehicle, causing his vehicle to hit a parked vehicle. Her vehicle came to rest on top of the double yellow lines, blocking both travel lanes. A CJIS check of XXXXX and SIMOES, yielded negative results. XXXXX will be summoned to court for Unlicensed Operation of a Motor Vehicle. All three vehicles involved were towed by Pat’s Towing.

 

Upon first approaching SIMOES, her eyes appeared red, glassy, and bloodshot. She was seated in the vehicle with the keys in the ignition and the engine running. Officer Soares had to repeatedly ask SIMOES to turn off the vehicle. SIMOES was asked multiple times in English and Portuguese for her registration before she was able to produce the document. While engaging her in conversation, Officer Soares detected an odor of alcohol emanating from her breath. SIMOES made spontaneous utterances to Officer Soares stating she “had a few drinks.” When asked to be more specific, she stated “two or three.” SIMOES repeatedly caressed Officer Soares’ left arm and hand, and had to be told multiples times to stop touching Officer Soares. I asked SIMOES where she was coming from, and she pointed in the direction of 608 Somerville Avenue which is where Samba, a night club, is located. SIMOES was asked to exit the vehicle, and asked to perform a series of Standardized Field Sobriety Tests. She agreed, and when given the option, elected to keep her high heel shoes on. SIMOES was positioned on a flat sidewalk with her back to the cruiser, and the lights of the cruiser facing us were shut off. I instructed and demonstrated Horizontal Gaze Nystagmus (HGN), Walk and Turn, and the One-Leg Stand by reading off of a reference card. Officer Soares translated my instructions to SIMOES in Portuguese.

 

During the HGN test, SIMOES displayed lack of smooth pursuit, and trailed the stimulus with her head after being repeatedly instructed not to. While performing the Walk and Turn, SIMOES missed the heel to toe on every step, raised her arms, and pivoted during the turn. During the One-Leg Stand, SIMOES was swaying, had to put her foot down at numbers 4 and 14, and used her arms for balance. SIMOES was subsequently placed under arrest for Operating Under the Influence of Alcohol, Unlicensed Operation of Motor Vehicle, Negligent Operation, and Marked Lanes violations. She was handcuffed (double-locked), and transported to the station for booking.
