On Monday March 27th 2023, I was on duty assigned to patrol cruiser east 1. At approximately 12:11PM, I was dispatched to XXX Assembly Row, XXXX, for a report of a male masturbating inside the dressing room with the door opened. Officer D. Lambert in patrol cruiser east 4 was dispatched as back up.

Upon arrival I was met by store manager Mr. XXXX. Mr. XXXX directed me to the dressing room area, and to a stall around the corner where the defendant was. Once I turned the corner I observed through a half-way opened door, a white male sitting down with his pants partially below his waist. Protruding from his pants I observed the defendant’s erected penis. I confronted the defendant and he rapidly raised his pants covering his penis. Shortly after, officer Lambert arrived. The defendant was identified as Mr. Joshua Sperling.

Officer Lambert spoke with the employee / victim Ms. XXXX who stated that as she was walking through the dressing room and observed a door open for one of the stalls. Then when she looked inside, she observed a male “completely exposed, masturbating”. Ms. XXXX stated that she was “shocked” and said “oh sorry” and walked away.

I placed the defendant under arrest for Lewd, Wanton and Lascivious Conduct, M.G.L. Ch.272 Sec.53/E.

The defendant was transported to Somerville Police headquarters via unit 200 and booked by Lt. Fusco.
