On July 28, 2018, I, Officer Tim Van Nostrand, was on duty and assigned to uniform patrol in marked cruiser 783. At approximately 8:01pm, I overheard Somerville Housing Investigator Officer Sean Browne radio that he was attempting to stop XXXX in front of X Memorial Rd due to have active arrest warrants. XXXX fled on foot onto Temple St where he was apprehended (Incident #18044881). During the apprehension, Officer Kevin Goulart (East 1) radioed for additional units to respond due to a hostile crowd forming around the officers.
I arrived on scene with numerous other units, and attempted to disperse the crowd. Most of the crowd obeyed commands to back up except for one male, identified as Armany Villa. On the previous day (July 27,2018) Villa interfered and created a scene during an arrest (See Detective Cicerone’s arrest report for #18044624). During today’s incident, Villa began recording officers at a close distance, and used loud vulgar language, attempting to incite the crowd. Villa was advised numerous times by Officer Devin Schneider (East 1) and Officer Samir Messaoudi (Tango 9) to back up to a safe distance, where he could record the incident. Villa refused numerous times, and at one point was close enough to make contact with the officer’s engaged in the arrest of XXXX. At this point, Officer Messaoudi observed Villa to be in possession of marijuana. Villa is under the age of 21, and his information was obtained in order to complete a civil citation. While Officer Messaoudi wrote the citation, Villa was seated on the curb and I was standing 3-4 feet away on Temple Rd. During this time, Villa was loud and boisterous, yelling to people on the opposite side of the road, and vehicles driving by. Two vehicles stopped in the middle of the road to yell back to Villa, causing a major traffic disruption. He was advised numerous times to cease his disorderly behavior. During this time, Villa constantly was spitting at his feet, and to his left between the cruiser and his left foot. Villa then spit in my direction, striking my left boot. Villa was then placed under arrest for assault and battery on a police officer, and disorderly conduct. Officer Messaoudi also issued a civil citation for the possession of marijuana by a person under 21 years of age.
During the arrest of Armany Villa, his sister, XXXX was recording from approximately 10 feet away. Her phone was seized, and a consent to search form was completed by XXXX and her mother with Officer Justin Brown at Somerville Police headquarters. The video ends prior to the assault and battery occurring. The phone was returned to XXXX.
Villa was transported to the station by Officer Justin Brown in unit 200, where he was booked by Lt. W Rymill.
