Real Life Somerville Police Stories:Tyrone SILVA (OUI, Dorchester Warrant)

The following is a summary of facts pertaining to incident #17053904:

 

On Thursday, August 31, 2017, I was assigned marked unit East 4. At approximately 11:38 pm, I was dispatched to the area of 159 Walnut St for the report of a motor vehicle accident. Officer Messaoudi(East 3), Officer Canty(East 1), and Officer O’Donnell(East 1) responded as backup.

 

On scene, we approached an unoccupied silver Nissan Altima, in the middle of the street, bearing Massachusetts plate XXXXX, which had damage to the passenger side front bumper. A group of bystanders directed me to the driver of the vehicle, later identified as Tyrone Silva. I asked Tyrone what had happened. Tyrone said, “I was driving down the street and I hit two cars. I will be honest with you, I’m intoxicated”. While talking to Tyrone, I noticed he had glassy, blood shot eyes, slurred speech, and I detected an odor of an alcoholic beverage on his breath. I asked Tyrone if he in fact consumed any alcohol that evening. Tyrone told me he had drank two beers and five nips. I asked him to perform a series of field sobriety tests and he refused. Once again Tyrone stated, “I’m not going to lie, I’m intoxicated. I could have run if I wanted to and you never would have found me. I stayed to do the right thing.” Based on Tyrone’s statements and my observations, I placed Tyrone under arrest for OUI Liquor.

 

I conducted a query of Massachusetts plate XXXXX and the result showed the plate was stolen out of Brockton (ORI/MA0120300). I conducted a query of the VIN YYYYY and the result showed that the vehicle was unregistered and uninsured. I requested a tow and during the inventory process I found the title of the vehicle. It lists Tyrone Silva as a purchaser and ZZZZZ as the seller with a purchase date of July 18, 2017.

 

Tyrone was transported by Officer James Radochia in unit 200 to the Somerville Police station where he was booked by Sgt. Marino.

 

Tyrone was charged with OUI Liquor c90 S24, Operating an Unregistered Motor Vehicle c90 S9, Operating an Uninsured Motor Vehicle c90 S34J, Attaching Wrong Motor Vehicle Plates c90 s23K, and Receiving Stolen Property -$250 c266 S60. After querying Tyrone’s name, I discovered he had an outstanding warrant out of Dorchester District Court for the following, Operating an Unregistered Motor Vehicle c90 S9, Operating an Uninsured Motor Vehicle c90 S34J, and Number Plates Violation to Conceal ID c90 S23.

 

During the booking process, Sgt. Marino advised Tyrone of his rights, and asked him to submit to a chemical test of his breath. Tyrone agreed. Officer Radochia administered a blood alcohol test to Tyrone with the test results of 0.19% BAC.

 

I issued Tyrone citation #’s R7881020 and R8325858 for the above mentioned infractions.
