Real Life Somerville Police Stories:Lucas BINDA (Unlicensed Operation of MV, Fail to Stop)

The following is a brief summary of the incident. It does not contain every minute detail of the incident. On October 17, 2016, at @ 8:38 PM, while assigned to the SPD Traffic Unit, operating Traffic Unit Tango 2, in full uniform, I was performing a Selective Enforcement assignment at the intersection of Somerville Ave, Washington St. and Prospect St. This area is a very high incident, traffic scofflaw intersection. I observed a motor vehicle approaching from the westerly direction of Somerville Ave. As it approached the intersection of Somerville Ave, Washington St, and Prospect St, I observed the traffic control signal turn from green to yellow to red. As the traffic signal turned red, I observed the approaching motor vehicle to be behind the stop line/crosswalk area on Somerville Ave. I observed this same motor vehicle proceed through the red light and turn left on to Washington St. (Ricky’s Flowers). Once the offending vehicle made the left turn, I activated my blue lights and pulled the vehicle over on Washington St. opposite Ricky’s Flowers. I approached the driver’s side of the vehicle and asked the operator for his license and registration. There was a language barrier issue but the operator was able to produce a valid registration. The operator could not produce a valid Mass. license. He did state to me that he had no license. I asked the operator/defendant for a passport. He stated that he did not have it on his person, but it was located at his residence. The operator was not sure of his residence due to a recent move. At this point I advised the operator/defendant to step out of the vehicle and to place his hands behind his back, which he did. The vehicle that the defendant was operating at the time of the stop was a 2013 Toyota Corolla, color gray. He did hand me what appears to be a Brazilian driver’s license. I believe that this document is a locally produced version of an authentic Brazilian driver’s license.


I ran a Query of the defendant’s license status through the RMV computer system on my Mobile Data Terminal (MDT). I received the following response in regards to my query, regarding the defendant, Lucas Binda: No Record(s) Found for Query. Translated, this means that defendant Binda does not possess a valid Massachusetts driver’s license in order to operate a motor vehicle in the Comm of Mass. Based upon receiving the info, I cited defendant Binda with Massachusetts Uniform Citation # R7880343 for the following motor vehicle violations: Not Duly Licensed and D.T.C.S. (Red Light). The defendant’s motor vehicle was towed from the scene.
