

On July 03, 2016, at approximately 17:20 hours, I, Officer Rivera, while in full uniform and working as East 4, was dispatched to Broadway and Temple Street for a report of a motor vehicle accident. Broadway and Temple Street are both public ways within the City of Somerville. Sergeant Kiely and Officer Anderson arrived as back up.
On arrival, I observed a male, now known to me as Adrian Deroche, standing in front of a green Chevrolet Malibu that was bearing MA registration XXXXXX. I also observed a female, now known to me as YYYYY, who was standing behind a red Toyota Corolla that was bearing MA registration YYYYYY. I approached Mr. Deroche and asked him if he could provide me with his license and registration. He complied and during our conversation, I detected a strong odor of an alcoholic beverage emanating from his breath. I also observed that he had red glassy eyes. I asked him if he was the driver of the Chevrolet Malibu and he said, “Yes, this is my car but it is under my fathers’ name.” I then retrieved the same documents from YYYYY and observed the damage to both vehicles. I then approached Mr. Deroche and asked him if he had consumed any alcoholic beverages today. He stated that he has not consumed any alcohol within the past two days. I then informed him of my observations and asked him if he will be willing to submit to a field sobriety test and he agreed. I also asked him how the accident occurred. He stated that he was driving out of a parking space on Temple Street and didn’t see the red car. After completing a motor vehicle crash exchange form, I asked Mr. Deroche if he would like to begin the field sobriety test. Mr. Deroche agreed and we walked to a flat area on the sidewalk where we began the test. I asked Mr. Deroche if he has any medical conditions that would prevent him from completing the test and he said, “No.” I then asked him if he wears prescription glasses or contacts and he said, “No.”
The first test I administered to Mr. Deroche was the Horizontal Gaze Nystagmus test. During the test I observed a lack of smooth pursuit, an involuntary jerking of the eyes prior to 45 degrees and a sustained and distinct Nystagmus at maximum deviation. The next test I administered was the nine step walk and turn test. I demonstrated this test to Mr. Deroche and advised him not to begin until he was told to do so. As I began to demonstrate this test, Mr. Deroche attempted to begin the nine step walk and turn without my instruction. I advised him again to not begin until he was instructed to do so. Mr. Deroche began the test and failed to touch his heel to his toe. He also failed to keep one foot on the ground when he turned around. As he was walking on the line, he also stepped to the side once. I then demonstrated the one leg stand. I instructed Mr. Deroche to raise one leg, either leg, approximately six inches off of the ground, with his foot pointed out. I also instructed Mr. Deroche to keep his eyes on the elevated foot. Mr. Deroche began the one leg stand and failed to keep his balance, dropping the elevated foot four times to the ground. At this point I asked Mr. Deroche if he had consumed any alcohol or drugs. He stated that he has not consumed any alcohol but he smoked “weed” approximately an hour to two hours ago. Because of my observations and failure of the field sobriety test, Mr. Deroche was placed under arrest. He was then transported to the station by mobile detention unit 200 that was operated by Officer Courtney Reece. An inventory search was done on Mr. Deroches’ vehicle, per department policy, before being towed by Pat’s Towing. During the search I discovered a small amount of a green leafy substance, that I believe through my training and experience to be marijuana, inside the rear part of the center consol. The small amount of marijuana will be logged into evidence.
Once at the station, Mr. Deroche was booked in the usual manner by Lieutenant DeOliveira. While at the booking window, Mr. Deroche was read the statutory rights and consent form to which he signed. He was also read his Miranda rights off of a form. I then conducted a field sobriety test on Mr. Deroche in the booking area that is audio and visually recorded. The first test I administered to Mr. Deroche was the Horizontal Gaze Nystagmus test. During the test I observed a lack of smooth pursuit, an involuntary jerking of the eyes prior to 45 degrees and a sustained and distinct Nystagmus at maximum deviation. The second test I administered was the nine step walk and turn. I demonstrated this test and instructed Mr. Deroche to begin. Mr. Deroche failed to touch his heel to toe on several steps. One the ninth step he failed to turn as I instructed him to. The third test I administered was the one leg stand. Mr. Deroche completed this test with fair results.
After the field sobriety test, Mr. Deroche was given the breathalyzer test by Officer Reece. The results showed that Mr. Deroche had a blood alcohol content level of 0.06. Shortly after the test, Medford Police Officer Iozza, a drug recognition expert, arrived at the station to conduct a test on Mr. Deroche. Officer Iozzas’ results will be attached to this report as soon as it becomes available.
Mr. Deroche was issued Massachusetts Citation R7634830 for operating under the influence of alcohol. All supporting documentation will be logged into evidence and be available upon request.
