Real Life Somerville Police Stories:B&E to Commit a Crime

Narrative

On Monday, December 28, 2015, while in full-uniformed patrol in marked-unit 876, Officer Canty and I were dispatched to XXX Broadway for a reported assault. Upon arrival, we spoke to the victim, XXXXX, who stated that an unknown black male had attempted and successfully got into her apartment, urinated at the bottom of her stairs and pushed her when confronted. She also was able to provide a photo, from her phone, of the suspect. We advised XXXXX that we had just observed the same black male, from the photo, walking eastbound on Broadway towards Magoun Square and instructed her we would be back shortly to assist.

Officer Canty and I then preceded to the area of 499 Broadway, in front of On The Hill Tavern, where we detained the individual, from the photo, Mr. James Huguley. As we approached Mr. Huguley, he immediately screamed “that b**** has my phone”. Officer Canty said “who has your phone” and he said “the b**** who called you, she stole it”. We then asked what he was doing in the house; he stated he went inside to stay warm. We advised him that entering someone’s house without permission is breaking and entering. He stated “I didn’t know that”. We then asked if he urinated inside XXXXX’s home and he stated “if there is piss there, it’s not from me”. I then asked why he pushed her, and he stated “because she has my phone”.

We advised him that he was going to be placed under arrest for breaking and entering, and he stated “it is not breaking and entering if the doors are open”. He was taken to the station by transport wagon #200 (Officer Isaacs) and booked per the usual manner by the commander, Lt. Vivolo.

We then followed up with the victim, XXXXX. She stated she heard her door open and when she looked down her stairs, there was a man urinating on her stairs. She screamed at him to leave and he left the apartment. She then stated he started banging on the door saying he wanted his phone back. She opened the door and he pushed her. As she stepped back, her dog came to her defense, scaring off Mr. Huguley. She was able to shut the door. Mr. Huguley continued to bang on the door stating he was going to kill her and he would be back to kill her dog. Mr. Huguley then left.

I asked XXXXX if the door was locked and she stated it locks automatically and was locked at the time of the occurrence. She believes he was banging so hard that it forced the door to open. She stated she was scared for her and her dog’s safety.

Respectfully submitted,

Officer Eric O’Brien #330
