Real Life Somerville Police Stories:Warrant Charges & Resisting Arrest

   
 
I, Officer Christine Bork, report the following summary of events based on direct and indirect interview with the persons named.

 

          On Friday November 27, 2015, I Officer Bork, was in full uniform and assigned to marked cruiser unit 875 patrolling area West 5 for the Somerville Police Department. Riding along with me was Officer Michael McCarey. At approximately 7:30 PM we were called to the area of 93 Temple Street regarding a past shoplifting incident. On location with me was Unit #93, Officer Sean Brown and East 4, Officer Chris Collette.

 

 

          While tending to the unrelated shoplifting incident, Officer Brown informed us that a male on scene, later identified as Jared Hiltz, may have warrants. Officer McCarey returned to cruiser #875 to perform a warrant check on Hiltz, where upon Hiltz with an active WMS warrant. At this time, Hiltz began walking away from the location. Officers McCarey and Brown called out to him to return, at which time he stopped. Officer McCarey stated that he had some court paperwork that he needed to be cleared up, and to place his hands on the fence. Hiltz complied with this request. Officer McCarey then informed him that he had an active arrest warrant. Officer McCarey grabbed his right hand, and Officer Brown grabbed his left hand in attempts to place him under arrest. Hiltz immediately tensed up, tighten his grip on the fence, and stated “Don’t do that”. Officer McCarey attempted to place his right hand behind his back, Hiltz then attempted to pull away. A struggle ensued. While attempting to gain control over Hiltz, he was told multiple times to stop resisting and place hands behind his back. Hiltz refused to comply with these lawful commands, and continued to pull his hands away from the four Officers that were now attempting to gain control of him. Officer McCarey was then able to gain control of Hiltz’s left hand and apply a handcuff to that hand only. With limited options, Officer McCarey connected the other end of the handcuff to the fence. Officer McCarey then stepped back and withdrew his department issued pepper spray and warned Hiltz that if he did not comply that he would be sprayed. Hiltz continued to struggle with Officers Bork, Collette, and Brown. At this time Officer McCarey deployed a one second burst of his pepper spray to Hiltz’s forehead. Hiltz was then able to be brought to the ground where he continued to struggle with Officers. Officer Brown was able to apply a second set of handcuffs to Hiltz’s right hand. The hand cuff holding his left hand was removed from the fence, and he was cuffed behind his back. Unit #200, Officers Cabral Jr. and Torres, arrived on scene to take custody of Hiltz. Hiltz was transported to Somerville PD headquarters where he was immediately given the opportunity to wash off his face and be decontaminated. Due to Hiltz’s tumultuous behavior after being decontaminated, the booking process had to be delayed until he was calm enough to be booked. He was then booked in the usual manner by Lt. Rymill.

 

          A complaint application for Jared Hiltz for resisting arrest 268/32B will be submitted to the court.
