On Sunday, January 30, 2022, at approximately 10:17 P.M., Somerville Police control received a 9-1-1 call from a victim identified as XXXX stating he was in the area of 78 Broadway, and someone was trying to assault him. While on the phone with the 9-1-1 operator, the victim said “He is trying to take my phone, he hit me”. The victim is heard asking people for help before the call was disconnected.
I responded to 78 Broadway along with Officers Ramirez and Pavao. Upon arrival, we located several people standing outside the store and pointing at a male walking away from the scene. The male was detained and identified as Luciano DELIRA.
The victim stated he was approached by DELIRA outside a Mexican restaurant on lower Broadway and asked him for money. When the victim declined to give DELIRA money, DELIRA headbutted the victim in the chest. The victim dialed 9-1-1, and while talking to the 9-1-1 operator, DELIRA took his phone and threw it against the wall causing damage to the screen, then punched the victim in the face. The victim then asked bystanders to call the police.
I observed a bruise on the victim’s face consistent with being punched and the phone screen was damaged.
Based on my observation and the victim’s statement, I placed DELIRA under arrest for assault and battery c.265 S13A, malicious defacement of property c.266 S126A, and intimidation of a witness c.268 S13.
While waiting for the prisoner transport vehicle, DELIRA told me I was making a big mistake and that he will get a gun bigger caliber than my duty weapon. While searching DELIRA before placing him in the prisoner transport vehicle, he headbutted me in the chest. DELIRA will be charged with assault and battery on a Police Officer c.265 S13D.
He was transported to the Somerville Police headquarters in unit 200, operated by Officer Taylor, and booked by Lieutenant deOliveira for the above-mentioned charges.
