On June 26, 2017, at approximately 17:15 hours, I, Officer Rivera, while in full uniform and working as Alpha 1, responded to the Nike Factory Outlet, 300 Artisan Way, with Alpha 3, Officer Fusco, for a report of a shoplifter who exited the store and walked towards Assembly Row.
On arrival, I spoke to Nike Associate, XXXXX. He stated that the suspect walked out of the store with a large amount of clothing without paying for it. He then stated that the suspect was wearing a coral tank top, black pants, and was carrying a large dark colored bag and a large purse. He also stated that the suspect has a piercing above the right eye.
Officer Fusco and I were able locate the suspect, now known to me as Phylecia Rucker, on 495 Artisan Way. This location is approximately two blocks away from the Nike Outlet. When I approached Ms. Rucker I immediately observed, in plain view, a red tank top with a Nike logo, inside of Ms. Rucker’s purse. I was able to recover 13 articles of clothing, with a total value of $298.40, from Ms. Rucker. I then informed Ms. Rucker that she was under arrest for Larceny Over $250. After querying Ms. Rucker’s information with the Somerville dispatch, I was informed that she had an active default warrant from the Lynn District Court, docket: 1713CR000601.
Ms. Rucker was transported to the station, via 200, that was operated by Officer Marra. Once at the station, she was booked in the usual manner by Lieutenant Rymill.
I conducted a follow up at the Nike Outlet and spoke to Nike Associate YYYYY. He stated that while on the sales floor, he observed Ms. Rucker select a large amount of clothing and observed her concealing the items in a large bag and purse. He stated that he also observed Ms. Rucker walking past all points of sale, failing to pay for the concealed merchandise, and exit the store.
