On Saturday, May 07, 2016 at 2:30 P.M., I received a call from Reebok Store Manager, XXXXX, stating he observed a Hispanic male wearing a blue hat and a red windbreaker, conceal two pairs of sneakers in his shopping bag. XXXXX stated when the shoplifter realized a store employee witnessed the incident, he returned the two pairs of sneakers to the shelf and left the store.
At 2:55 P.M., I received a call from Puma Store Manager, YYYYY, stating he observed a male shoplifter conceal a pair of sneakers in a shopping bag, and exit the store without making any attempt to pay for the merchandise.
I asked YYYYY to describe the shoplifter and he stated; “Hispanic male, wearing a blue hat and a red jacket.” I notified Somerville Police Control of my location and Officer VanNostrand responded as backup.
I located a man matching the description near the intersection of Artisan Way and Grand Union Blvd. I approached the man and asked him to place his bag on the ground, and observed a pair of sneakers inside his bag.
The man identified himself as Juan Guzman, and provided me with five different social security numbers; none of which matched his name and date of birth.
I confirmed that the sneakers I recovered were property of Puma, and placed Mr. Guzman under arrest for shoplifting by concealing. I conducted a pat frisk of the defendant and recovered one hypodermic needle from his back pocket.
The defendant was transported to the Somerville Police Headquarters via unit 200, operated by Officer Pavao.
During booking, lieutenant Rymill asked the defendant to state his name and the defendant gave “Juan Guzman” as his name and “XX/XX/XXXX” as his date of birth. I reviewed the fingerprint results of the defendant and learned that his true name is Luis Acosta. I conducted a query in the CJIS database and found two outstanding warrants for his arrest out of Boston District Court.
In addition to shoplifting, the defendant will be charged with furnishing a false name or social security number.
