Real Life Somerville Police Stories:Daniel RIVERA (Forge RMV Document, False Name, Unlicensed Operation of MV)

On December 26th, 2015, I Officer James Torres, was in full uniform while assigned to marked unit East 4 during the day shift, along with Officer Devin Schneider. We were conducting a random query of MA registrations when at approximately 11:00 AM; I observed a vehicle baring MA Reg 6LCG70 that showed the owner of the vehicle having a suspended license. I activated the cruiser blue lights and pulled the vehicle over in front of 16 Jaques street which is a public way.

As I approached vehicle I noticed that the driver was not wearing a seatbelt. I requested the driver to provide me with his license and registration. The driver informed me that he did not have a driver’s license and that he only had a license in his home country. I asked the driver to step out of the vehicle. I asked the driver if he could identify himself. The driver produced what I believed to be a fake license given my training and experience, out of Honduras, identifying the driver as Daniel Rivera Avila.

After running the above name and DOB, officers were unable to confirm his identity. I asked the driver if the name on his Honduran license was correct and if the license was fake. The driver stated that it was his real name on the license but the license was fake. I then spoke with the passenger subsequently identified as XXXXX. XXXXX identified the driver as Eduin Daniel Rivera.

The driver was placed under arrest for ch. 90/10 UNLICENSED OPERATION OF A MOTOR VEHICLE, ch. 90/24B RMV UTTER FAKE VEHICLE DOCUMENT and given a verbal warning for not wearing a seat belt.

Mr. Rivera was transported to the Somerville Police station in prisoner transport unit-200, operated by Officer Ashley Catatao, where he was booked in the usual manner by LT. Michael Mulcahy.

Respectfully submitted,

Officer James Torres
