HENRY TAPIA Arrest

On May 9, 2015, I, Officer Tim Van Nostrand, was on duty and assigned to uniform patrol in marked cruiser East 1. At approximately 11:44am, I was dispatched along with Officer Randy Isaacs (East 2) to 30 Inner Belt Rd for an assault. Officer’s Erick Ubeda (East 3) and Chris Collette (East 4) also responded. Upon arrival, the involved parties had been separated. I observed a black male to be sitting on the ground, and appeared to be suffering from some sort of medical issue.

Witnesses pointed me to the other involved party, identified as Henry Tapia. I asked Tapia what happened. He stated an argument ensued after the victim, , took his seat in the cafeteria. Tapia stated he felt like he was being disrespected, and decided to fight it out. was unresponsive, therefore I could not hear his version of the events. Officer’s Ubeda and Isaacs interviewed numerous witnesses. Some gave a version that had Tapia kicking Pierre when he was down with a work boot.

I was able to review CCTV footage with captured the entire event. I was unable to secure a copy of the footage at this time, but Monday morning an employee will be on scene that is capable of saving the footage. I witnessed Tapia being the primary aggressor on the video. Tapia used a metal folding chair to strike Pierre, and push him into a vending machine. Tapia proceeds to place Pierre in a head lock and throws numerous punches toward the head and face region. The two men end up on the floor, where Tapia continues to throw punches. I did not see xxxxxx throw any punches. As witnesses began to try and separate the two, Tapia attempts to kickxxxxxx with his work boot. Tapia also stated his intent to kick xxxxx with his boot to me in conversation.

Due to the conclusive video evidence, and numerous witness statements, I placed Henry Tapia under arrest for Assault and Battery with a Dangerous Weapon – to wit metal folding chair (265/15A), and Assault with a Dangerous Weapon – to wit shod foot (265/15B)

Officer Diaz transported Tapia to the station in unit 200, where he was booked by Lt. Digregorio in the usual manner.xxxxxx was transported to Cambridge Hospital with potential head and neck injuries. At the time of this report, he was still undergoing testing, and was in too much pain to speak with me.
