Lopes Arrest

On the above date and time, I was dispatched to 80 Webster Avenue for a motor vehicle accident.
As I was responding to 80 Webster Avenue, Somerville Control informed me via radio transmission, that a fight broke out between two parties. Officer Devin Schneider also responded to 80 Webster Avenue to assist me.

Upon my arrival, I was met by (operator) and (front passenger) who were occupants of MA , a 2013 gray Nissan Sentra. victim stated that she was travelling south on Webster Avenue, a public way, when she stopped her motor vehicle to allow a plow truck to drive by, due to the unusual snow fall making the roadways extremely narrow. As v waited for the plow truck to drive by, she felt an impact on the rear of her vehicle. v then exited the vehicle to access the damage, and to interact with the defendant, Mario Lopes. v stated that Lopes made incoherent statements, then he fled the scene in MA #857WD9, a 2004 red Mercedes ML350.

It was brought to my attention, that Cambridge Police had Lopes stopped and detained at 1157 Cambridge Street, Cambridge, also a public way. At my request Officer Schneider responded to 1157 Cambridge Street to ascertain Lopes’ account of the event which had transpired.

An accident report was filed, and two Massachusetts Uniform Citations, R3692360 and R4791001 were issued to Lopes. With the permission of Sierra 9, Sergeant Martha Costa, Lopes’ motor vehicle was towed by Pat’s Towing incident to arrest. An inventory search of Lopes’ vehicle was performed by Officer Schneider. During the inventory search, Officer Schneider found a bottle of Amsterdam Vodka approximately 1/3 full, laying on the floor behind the driver’s seat. Officer Schneider relinquished possession of the bottle of vodka to me at the Somerville Police Station. At the Somerville Police Station, Lopes agreed to perform a Chemical Breath Test. The breath test report results stated that Lopes’ blood alcohol concentration was 0.23%. Note: Officer Brian Pavao was the operator of the breath test instrument.
