Narrative
On November, 27th 2013, I Detective Ariel Collazo along with the following Detectives; Kevin Shackelford, James Hyde, and James Slattery were working in plain clothes in an undercover capacity as, Narcotics Detectives conducting routine narcotic interdiction surveillance within the Winter Hill area of the City of Somerville.This aforementioned area is considered a high volume drug area due to the historical reputation of illegal drug distribution and personal use. At approximately 3:20pm, I observed an individual known to me as, Mr. Charles Ryan walking with Mr. Nicholas Cunha. Mr. Ryan has been the focus of previous Narcotics related investigations and has been arrested by the Somerville Police Narcotics Unit for violations of the controlled substance laws.Mr. Ryan presently has an open case pending before the Somerville District Court for the Distribution of a Class “A” substance to wit Heroin.

At this time, I observed Mr. Ryan and Mr. Cunha walking on Jacques St. a rolling surveillance was maintained of Mr. Ryan and Mr. Cunha. Surveillance followed Mr. Ryan and Mr. Cunha at which time observations were made of them meeting with a gray motor vehicle bearing a New York registration. I observed Mr. Ryan approach the driver window and a hand exchange occurred between Mr. Ryan and the driver of the gray motor vehicle. At the conclusion of the hand exchange Mr. Ryan and Mr. Cunha departed Jacques St. on foot. Observations were then made of them entering to a awaiting motor vehicle bearing the Massachusetts Registration parked on Wheatland St. The vehicle proceeded to depart the area and then stop and park at Winter Hill Market. All three occupants then exited the vehicle. Mr. Ryan was observed entering Dragon Star Chinese Restaurant and exiting quickly. The driver later identified as PERSON OF INTEREST, Mr. Ryan and Mr. Cuhna entered the vehicle and left the area. A rolling surveillance was again maintained,as the motor vehicle proceeded along Grant St. passing by the Elizabeth Peabody house. The vehicle then turned left onto Sydney St. then a right onto Taylor St. The vehicle then took a right onto Mystic Ave. and parking in front of Mystic flowers. Mr. Ryan exited the vehicle and walk and entered the Salvadorean restaurant. Seconds later Mr. Ryan exited the restaurant and walked back to the awaiting vehicle and stood at the passenger door. At this point Mr. Cunha exited the vehicle and left the area with Mr. Ryan and both men entered the Salvadorean restaurant. At this point myself along with East 4 Officer Capasso and Officer Khoury and Det. Hyde and Slattery conducted a motor vehicle stop for the purpose of conducting a threshold inquiry. Mr. Ryan and Mr. Cunha observed the police lights and motor vehicle stop as they both exited the restaurant and fled on foot down Mystic Ave and running along Wheatland St. Mr. Ryan ignored several verbal orders to cease his flight Mr. Ryan was subsequently apprehended after a foot pursuit by Det. Hyde and Slattery. Det. Slattery observed Mr. Ryan discard 4 men watches to the ground. A search of Mr. Ryans person revealed $ 968.00 U. S. currency stored inside of his left pants pocket. Post-Miranda Mr. Ryan offered conflicting statements regarding the total amount of the currency and its root of origin.

After a subsequent search of the area Mr. Nicholas Cunha was observed walking down Mystic Ave. Mr. Cunha was brought back to the Salvadorean restaurant and scene of this incident. While conducting a search of the motor vehicle in question several unused hypodermic needles / syringes along with a loaded needle were located in the back pack belonging to Mr. Cunha. This needle contained a liquefied substance believed to be Heroin that was perceived as in preparation for personal use. Post – Miranda Mr. Cunha acknowledged that the backpack belonged to him.

In furtherance of this investigation interviews were conducted of individuals involved in this incident. It was learned during the course of the interviews that Mr. Ryan was allegedly distributing various quantities of Heroin to perspective Heroin customers. It was further learned that Mr. Ryan currently stored a quantity of Heroin (11 bags of a substance believed to be Heroin) inside of an electronic clavo / hidden compartment that was the product of an after market installation inside of the motor vehicle in question. As a result of the interviews and corresponding cooperation the clavo / hidden compartment was located and searched. The results realized of the clavo / hidden compartment supported the interviewee allegation. In addition further incriminating information was realized regarding Mr. Ryans alleged Heroin distribution operation.
The following items were taken and placed into evidence 11 clear knotted baggies (Evidence tag # 13044121-1)
and $968.00 in US Currency (Evidence tag # 13044121-2). I would note that the criminal activity engaged in by the defendants and violations of the controlled substance laws occurred in and within 300 feet of the Elizabeth Peabody House Daycare Center a certified Daycare recognized by the Commonwealth of Massachusetts.
