Real Life Somerville Police Stories: (FIREARM, CARRY WITHOUT LICENSE, COCAINE, POSSESS TO DISTRIBUTE, DRUG VIOLATION NEAR SCHOOL/PARK) (Somerville Warrant)

The following is a brief summary to incident/investigation (s) #22041832/#22036749.

Members of the Somerville Police Department have been investigating an Armed Car Jacking that occurred at 460 Mystic Ave in Somerville Ma, on July 01, 2022. During the course of this investigation Detective Cicerone and I, were able to Identify two males that were involved in this incident. One male was identified as Daniel Vivas Miguel (DOB XXXX). I would note that Daniel Vivas Miguel is known to carry firearms.

On July 28, 2022, I applied and was granted by the Somerville District Court two arrest warrants and two search warrants for this ongoing investigation. One of the search warrants (Docket #2210-SW-64) was for the search of 10 Pinckney Street #1 in Somerville Ma and the person of Daniel Vivas Miguel (DOB XXXX). The other search warrant and an arrest warrant was for another location and individual within the city of Somerville Ma, that was involved in the original incident as well.

On July 28, 2022, At 9:00 AM, Sergeant Rego and Detective Cicerone set up surveillance in the area of 10 Pinckney Street in an attempt to execute an arrest and search warrant of Daniel Vivas Miguel, as I along with Detective Pasqualino setup surveillance at another location in a attempt to execute an arrest and search warrant of another individual that was involved in the Armed Car Jacking.

At 1:30 PM, observations were made by Detective Cicerone of Daniel Vivas Miguel leaving his residence of 10 Pinckney Street #1. At this time Detective Cicerone advised us over our 2way radios of his observations. At this point Detective Pasqualino and I left our location and proceeded to the area of Pinckney Street in an attempt to place Daniel Vivas Miguel under arrest and execute the search warrant of his body and of his residence.

Detective Cicerone and Sergeant Rego ended up conducting surveillance of Daniel Vivas Miguel as he ended up walking to the Florence Street Public Park / Play Ground, where he met a waiting male that was sitting on one of the benches. This male was later identified as XXXX (DOB XXXX). I would note that this public park/playground is owned and maintained by the city of Somerville. I would also note that XXXX is known to carry firearms.

Shortly after Detective Cicerone and Sergeant Rego exited their vehicles and began to walk into the Park / Play Ground in an attempt to execute an arrest and search warrant of Daniel Vivas Miguel, as Detective Pasqualino and I were in route to assist. Upon my arrival, I placed XXXX into handcuffs for safety and I then pat frisked him for weapons. At this time Daniel Vivas Miguel was placed under arrest and was advised of and provided a copy of the search warrant. (Please see Detective Cicerone supplement report regarding details of this arrest). Also arriving on scene to assist were uniformed Officers Joseph Moreira and Officer Kyle Lentini.

At this time Detective Cicerone executed the search warrant (Docket #2210-SW-64) of Daniel Vivas Miguel person.

– On his person a loaded 10 mm Glock 29 Jen4 (Serial # XXXX) was found. (The magazine was loaded with ten 10mm rounds and that magazine was inserted in the firearm). In furtherance of this investigation, an inquiry was made with the Massachusetts Registry of Motor Vehicles. This inquiry revealed that Daniel Vivas Miguel has an MA ID only (#XXXX). An inquiry was also done to see if Daniel Vivas Miguel possessed a license to carry a firearm or FID card. This query showed that he does not possess a license to carry a firearm or FID card.

-Also found on his person was a bag of Crack Cocaine (preliminary weight 6 Grams), and 2 digital scales. Based on the amount of Crack Cocaine seized from Daniel Vivas Miguel, which is consistent with someone who will possess with the intent to distribute them, the digital weigh scales. I formed the opinion that Daniel Vivas Miguel possessed the Crack Cocaine with the intent to distribute them.

-One thousand one hundred forty nine dollars were also seized from Daniel Vivas Miguel prisoner property and will be subject for forfeiture as we believe this US currency are proceeds from Daniel Vivas Miguel Crack Cocaine Distribution operation.

Daniel Vivas Miguel was shortly then transported to Somerville Police Headquarters, were he was booked by Lt. G Rymill.

Daniel Vivas Miguel was arrested on the active arrest warrant and charged additionally with the following charges :

– C269/S10N UNLAWFUL POSSESSION OF A LOADED FIREARM (The magazine was loaded with ten 10mm rounds and that magazine was inserted in the firearm).

-C269 S10 FIREARM, CARRY WITHOUT LICENSE.

-C265/S18B USE OF A FIREARM WHILE COMMITTING A FELONY.

-C94C/32A/C COCAINE, POSSESS TO DISTRIBUTE.

-94C/32J DRUG VIOLATION NEAR SCHOOL/PARK.

After Daniel Vivas Miguel was transported to Somerville Police Headquarters, Detectives proceeded to his residence at 10 Pinckney Street #1 in Somerville Ma and executed the search warrant of his residence. (See report # 22041834 for details of that search warrant execution).
