Real Life Somerville Police Stories: Alan KELLY (OUI Liquor, Negligent Operation)

I, Officer Roger Desrochers, report the following summary of events based on direct interview with the persons named.

On Tuesday, November 17, 2020, I, Officer Desrochers, was in full-uniform and assigned to marked cruiser 665(E2), and patrolling the East district, for the Somerville Police Department when I was dispatched along with E3 Officer Khoury and E4 Officer Lambert to 51 Springfield Street for a reported car accident.

Upon arrival dispatch informed arriving units that the vehicle in question had struck 2 parked cars. Officer Lambert was the first to arrive and called for a traffic unit and an Emergency Response from Somerville Fire and Cataldo Ambulance. Once I arrived on scene I saw a black Ford F250 which belonged to Alan D Kelly, close to a white SUV which had no damage however the two trucks in front of it did. They were a black GMC Sierra and which had damage on the drivers side from the front bumper to the rear bumper, and the second was a white Chevy Silverado which also had damage on the drivers side from the front bumper to the rear bumper. I then noticed a male who was wearing a black sweat shirt and tan pants that was later identified as Mr. Kelly. As I was looking at Mr. Kelly I noticed that his eyes were red and glassy, as I began to speak with Mr. Kelly I could smell an odor or alcohol emanating from his person, and he was slurring his speech. After about a min of speaking with Mr. Kelly who was read his Miranda rights from a card I keep on my person I would learn that he had about 2 alcoholic beverages while working on Cambridge Street in Cambridge. And then was driving home to Medford when he says that he swerved to miss an oncoming car, and crashed into the two vehicles that were parked on the road. For precaution of Mr. Kelly, he was evaluated and refused further medical from Cataldo Ambulance.

At this point I informed Mr. Kelly that if he was hurt he should be seen at the hospital, Mr. Kelly told me that he was not injured. Knowing that Mr. Kelly was not injured and under the influence of Alcohol I asked him to submit to field sobriety test at the scene of the crash. Mr. Kelly stated will not take not test for me. Once Mr. Kelly refused these test he informed that he was under arrest and placed into two sets of handcuffs which were double locked behind his back. Unit 200 which was operated by Officer Duval was called to transport Mr. Kelly back to the police station to be book by Sergeant St Hilaire in the usual manor. During the booking process Mr. Kelly once again refused to take field sobriety test, as well as a Breathalyzer. Mr. Kelly’s license has been entered into the CJIS data base and seized. Based off of the above information Mr. Kelly was placed under arrest and issued MA uniform citation # T1229440 for the following.

The Video obtained from a Doorbell camera will be saved and the photos from the crash will be added to this report. On top of this report Officer Ubida will be filing a crash report. Mr. Kelly’s vehichle was towed by Pats Tow
