The following is a summary of the details related to this incident.
On Sunday, April 7, 2019, I, Officer David Ruf, was in full-uniform and assigned to marked cruiser East-4, for the Somerville Police Department. At approximately 12:41 A.M., I was parked in front of 105 Broadway, a public way in the city of Somerville, I observed a white Honda Accord bearing Massachusetts registration xxxxx pass me at a high rate of speed and was not displaying their headlights. I estimated them to be traveling at approximately 50 mph in a 25 mph zone.
I activated my emergency equipment and attempted to stop the vehicle. The vehicle continued to travel down Broadway at a high rate of speed hitting a curb at the intersection of Broadway and Cross Street. I was able to finally stop the vehicle near the intersection of McGrath Hwy and Broadway. I radioed my location to Somerville Dispatch and Officer Bork arrived on scene as back up. I approached the operator, later identified as Michael GOGGIN, and ordered him to shut the vehicle off, step out, and then placed him in handcuffs for officer safety. I observed GOGGIN to be unsteady on his feet when he exited the vehicle. I could smell the odor of an alcoholic beverage emitting from his person, his speech was slurred, and his eyes appeared to be blood shot. I attempted to ask GOGGIN basic questions and he stated that he was already “Done” and told me to go “Fuck my mother”. I asked GOGGIN to take a field sobriety test and he refused. After he refused, GOGGIN continued his tumultuous behavior yelling obscenities at officers. I attempted to inform GOGGIN that he was now under arrest for OUI Liquor and he stated “Lawyer”.
GOGGIN was charged with the following offenses;
M.G.L c90 / § 24 OUI LIQUOR
M.G.L c90 / § 24 NEGLIGENT OPERATION OF A M/V
M.G.L c90 / § 17 SPEEDING
M.G.L c90 / § 7 FAILURE TO DISPLAY HEADLIGHTS
GOGGIN was transported by Unit #200 (Officer M. Canty) to Somerville Police Headquarters. It should be noted that while waiting for the prisoner transport wagon to arrive on scene, GOGGIN spontaneously uttered “I’m already drunk” to Officer Bork. During the booking process Sgt. Holland informed GOGGIN of his rights and asked him to submit to a chemical test of his breath. GOGGIN refused to take the chemical test and refused to sign the consent form as a refusal. I issued GOGGIN Mass uniform citation #T1229695 for the above-mentioned offenses and placed it in his property bag along with the notice of suspension for chemical test refusal.
