Real Life Somerville Police Stories: Marvin ALVAREZ-HERNANDEZ (Trespass)

On Wednesday, January 17, 2018 I, Officer Justin Buswell, worked my assigned 8am-4pm shift in marked Somerville Police Cruiser East-1, and in full-uniform. The following is a summary of the events that I witnessed as they pertain to Incident# 18003364:

At approximately 8:57 am, I, along with Officer Devin Schneider (East-1) and Officer Michael McCarey were dispatched to XXX Broadway, for a report of an unwanted male individual in the basement named Marvin.

Upon arrival, I spoke with XXXX, who told me the following:

He is the operations manager for the XXXX. XXXX has been having an ongoing issue with a male party, later identified as Marvin ALVAREZ-HERNANDEZ, sleeping in the basement for the last couple of months. Somerville Police Officers have been involved with this issue for the last two weeks, reference Incident# 18001083, 18003267, 18003310. He has told ALVAREZ-HERNANDEZ on or at least four occasions that he can recall that he was not allowed to be on the property. He recalls telling him this on the following dates: 12/1/17, 12/15/17, 12/31/17, and 1/1/18.

Officer Schneider, Officer McCarey, and I then proceeded to the basement were we located ALVEZ-HERNANDEZ, who told me the following:

He is homeless and is a member of XXXX. When asked if he knew he was trespassed and not allowed to be on the property, he told me that he knew he could not be on the property. He made entry into the building through a secure back window.

ALVEZ-HERNANDEZ was then placed under arrest. I handcuffed ALVEZ-HERNANDEZ behind his back, double locked, and checked for proper tightness. ALVEZ-HERNANDEZ was transported back to the station in Prison Transport Unit-200 by Officer Daniel Haley. At the station ALVEZ-HERNANDEZ was booked in the usual manner by Lt. William Rymill.

It should be noted that the building was secured when COLE showed up this morning. On 1/16/18 (Incident #18003310) ALVAREZ-HERNANDEZ was trespassed from XXXX by XXXX.

I will be filing criminal charges against Marvin ALVEZ-HERNANDEZ for the following violation of Massachusetts General Law:
