Real Life Somerville Police Stories:Daniel CUNHA (B&E, Larceny)

On Thursday, March 30, 2017, at 5:35 A.M., I responded along with Officers Khoury and Bork to XX Pearl Street for a larceny from a building. Somerville Police control advised responding units that the suspect was a white male in his twenties, small in size, wearing a blue hoodie with a black jacket over it, blue jeans and sneakers. The suspect was pushing a wheelbarrow, walking away from the victim’s house towards Pinckney Street then turned left onto Pinckney Place.

 

Upon arrival, I observed several tools in the driveway and backyard of XX Pearl Street, and three hinges were removed from a shed door. 

 

I spoke with the reporting party, XXXXX, who stated that she saw a white man, approximately 5’4″ tall, 120 lbs, wearing a blue hoodie and a dark jacket, exit the backyard of 3X Pearl Street. The man was carrying several items and ran towards Pinckney Street. The same person came back again and left with more items.

 

I then spoke with the victim, YYYYY, who stated as he was leaving his house to go to work, he saw a man pushing a wheelbarrow full of tools out of his driveway. YYYYY confronted the man, and he took off running towards Pinckney Street. YYYYY recognized the man from the neighborhood and stated that he had seen him before. At this time XXXXX called Somerville Police and reported the incident.

 

XXXXX stated that the man YYYYY confronted outside his house is the same person she saw twice leave the victim’s house. She also observed a second man was walking his dog (a German shepherd) that walked onto Pinckney Place around the same time. 

 

YYYYY believed that the suspect and the person walking the dog were brothers and were known to him. We responded to Pinckney Place, Officer Khoury located a German shepherd in the backyard of 9 Pinckney Place. We made contact with the owner, ZZZZZ, and asked him if other people were in the house. ZZZZZ stated that he lives in the basement and his brother Daniel Cunha lives on the second floor apartment with his mother. 

 

We then made contact with Daniel Cunha, I read both men their Miranda rights, and both agreed to talk to me. ZZZZZ stated that he walked his dog around the victim’s house, and Daniel stated he walked by the house, pushing a dolly and was trying to get some rocks and sand from one of the side streets.

 

Officers Khoury and Bork conducted a show-up but the victim was unable to identify the suspect. Stating he was not sure. 

 

At approximately 8:20 A.M., Somerville Police control received a call from the victim, stating that ZZZZZ came to his house and told him his brother Daniel stole tools from his shed and he would like to return them.

 

I responded to 9 Pinckney Street, I advised Daniel Cunha of his Miranda rights. Daniel stated he understood his rights and decided to waive them. 

 

Daniel stated that around 3:30 A.M., he went to the victim’s house. Using a screw driver he removed the hinges off the shed door, and then loaded a wheelbarrow he found in the victim’s yard and transported the stolen items to his house.

 

Daniel also stated that he returned a second time using a dolly he retrieved from his back yard and removed several tools from the victim’s property.

 

I also located a green Schwinn bicycle in the victim’s backyard. I asked the victim if the bicycle belonged to him and he stated that it did not. I asked Daniel about the bicycle and he stated that he took it from 2X Pearl Street. 

 

The tools valued at approximately $1700 were recovered and returned to YYYYY.

 

I placed Mr. Daniel Cunha under arrest for breaking and entering and larceny over $250.

 

He was transported to Somerville Police Headquarters via unit 200, operated by Officer Rivera and booked by Lieutenant Vivolo.
