On Monday, February 01, 2016 at 11:57 A.M., I received a call on my department issued phone from Saks’ Loss Prevention agent, XXXXX, who stated he had observed a male conceal sunglasses in his jacket and exit the store without paying for the merchandise.
I asked XXXXX to stay on the phone; he then informed me that the man entered a white sedan, and was seated in the rear passenger seat. As I made a right turn from Artisan Way to Grand Union Blvd., I saw a white Chrysler 300 traveling directly in front my cruiser.
I stopped the vehicle on McGrath Hwy near the intersection of Grand Union Blvd., informed Somerville Police control of my location and Officer Schneider responded as backup.
I informed the driver of the reason of the stop and asked him and the two passengers for identification. The operator gave Officer Schneider (Salone Kabra). The front seat passenger was identified as YYYYY and the rear passenger was identified as Miguel Chavez.
I informed Mr. Chavez that I have a witness who saw him conceal merchandise and leave the store without paying. Mr. Chavez took two pairs of sunglasses (price tags and censors attached) from his jacket pocket and hand them to me.
I asked Mr. Chavez to step out of the vehicle and observed two censors and a magnet in plain view on the rear passenger seat. I showed the censors to Mr. Chavez and he stated to me he has to more pairs under the seat. I recovered two more pairs from under the front passenger seat.
Officer Schneider also recovered another magnet and a pair of nail clippers from the rear door side well. These devices are commonly used to remove security censors.
I identified the operator as Mr. Hugo Cabrera. I was informed by Officer Schneider that the status of Mr. Cabrera’s license is suspended.
I placed Mr. Chavez under arrest for Larceny over $250 and Possession of Theft Detection Deactivator or Remover, and Mr. Cabrera for operating a motor vehicle with a suspended license and giving a false name to a Police Officer.
Mr. Chavez and Cabrera were transported to the Somerville Police Headquarters via unit 200, and booked by lieutenant Mulcahy.
Four pairs of sunglasses (total value $419.96) were returned to Saks. Censors, magnets and nail clippers will be tagged and placed into evidence.
I issued citation# R6636127 to Mr. Cabrera and placed it in his property bag.
