Narrative
On Friday, December 6th, 2013, I, Officer Schneider, was in full uniform assigned to unit West-7 during the day shift. The following is a summary of events that I witnessed that day, as they pertain to incident #13045012:

At approximately 1:41pm I received a dispatch to Ossipee Rd for a report that: jv1 was in the basement with kids and they had dragged in a safe that they were trying break into. I would note that I am familiar with jv1 who resides at that address, as I have had several encounters with him.

Ofc. Manfra (West-6) arrived on scene first. Ofc. Manfra met jv1 and his legal guardian, , at the front door. After speaking with them for a short time, Guardian indicated that the suspects were around back of the house. At this point I arrived on scene. With Guardian’s permission, Ofc. Manfra and myself were escorted by jv1 and guardian around the back of the house.

In the back lot of the house were three males who were identified as: jv2, Christopher Richards, and jv3 . The three males were standing approximately ten feet away from a safe that was under the back porch. The safe was lying on its back and the door of the safe was heavily damaged, as though someone was attampting to break it open. Strewn around the safe was a crowbar, a small shovel, screwdriver and nail puller. I observed that a powdery substance between the walls of the cracked safe was all over the ground and caked on the tools. I observed what appeared to be the same substance on each of the male suspects clothing.

Due to each of the male suspect repeatedly ignoring my orders to remove their hands from their pockets and failure to comply with orders given for officer safety, I called dispatch via radio to send an additional unit as back up. Each of the males were pat frisked for weapons. A short time later, Ofc. Guillen (West-5) arrived on scene to assist.

I asked the group what was going on, and the males just shrugged or looked away. I then spoke with guardian. guardian stated that she had heard the sounds of banging coming from the back yard, but was unsure of what was occurring. she stated that jv1 had come in to the house at one point during the banging and stated: “something about a safe.”

I separated Xxxxxxxx from the rest of the suspects and read him his Miranda rights from a pre-printed notebook. I asked Richards if he understood his rights and he stated that he did. I asked Richards if he would like to speak to me and he stated that he would. The following is a summary of Xxxxxxxxxx statements to me:

I separated jv1 from the rest of the suspects along with his Aunt and legal guardian, . With her permission, I read him his Miranda rights from a pre-printed notebook. After reading jv1 his rights, I asked him if he understood his rights and he stated that he did. With guardians ‘s permission, I asked jv1 if he would like to speak to me and he stated that he would. Lying next to the safe were some papers that appeared to have come from the safe. On one of the papers was the name, . I stated, “I wonder who v is?” jv3 stated, “I know. It’s my Aunt.”

I separated jv3 from the rest of the group and asked him, “Is there something you want to tell me?” jv3 stated, “Ya

All four males were placed under arrest and put into handcuffs in the manner consistent with our training. Unit 200 operated by Ofc. Nevin transported the prisoners back to the police station, where they were booked in the usual manner by Lt. Mulcahy.

I will be filing for the following charges against Xxxxxxxxx, jv2, jv3 and jv1:

ch.266/s.16 – Breaking into a Depository
ch.266/s.49 – Possession of Burglarious Instruments
ch.266/s.60 – Receiving Stolen Property

At the scene, I took photographs of the safe and tools as we discovered them using my cell phone, emailed them to myself and attached them digitally to this report. I then deleted them from my cell phone.

I secured the safe and tools in my cruiser. I transported the safe and tools back to the station where they were entered and secured into evidence in the usual manner.

At the station Sgt. Marino and myself were able to open the safe there and inventory the contents in the booking area, which is recorded both visually and audioly via Somerville PD’s CCTV. Inside the safe was $6,880 in U.S. currency, 2 digital cameras, misc gold + silver bracelets, rings and earrings, 3 boxes of blank checks, 1 red Nintendo 3DS, personal papers, passports, and a rubber piggy bank full of coins. A picture of the property was taken with my personal cell phone, emailed to myself, and attached digitally to this report then deleted from my phone. The property was then secured in evidence locker #4.
