Real Life Somerville Police Stories:Filsdym MODAN (B&E Residential)

On August 18, 2017, I, Officer Tim Van Nostrand, was on duty and assigned to uniform patrol in marked cruiser East 1 along with Officer Justin Brown. At approximately 10:46am, we were dispatched to 510 Mystic Ave Apartment along with Officer Brian Pavao (East 4) and SHA Chief Dan Meade (Unit 93) for a past breaking and entering.

 

Upon arrival, I spoke with Chief Meade who reports he received a phone call from a resident, XXXXX, about a possible breaking and entering he witnessed. XXXXX was contacted and responded to the scene. XXXXX stated he was walking on the walkway from 480 Mystic Ave that proceeds between the 500 and 510 Mystic Ave buildings. XXXXX observed a black male, approximately 25 years old, wearing a white shirt, blue jeans, and having shoulder length dreads exit the window of an apartment in the 510 Mystic Ave building. XXXXX also reported this male was carrying a black back pack. XXXXX is familiar with the tenant of the apartment in question and stated they have not been around. Chief Meade advised me the tenant is YYYYY. Chief Meade contacted YYYYY who stated no one was authorized to be in their apartment. YYYYY gave us permission to enter and check their residence.

 

Once inside we searched the apartment for individuals or sign of a crime. We located a bedroom window open, and the screen pulled up. It was unable to be determined if anything was missing at this time. The window was secured, and we responded to the adjacent building, 7 Memorial Rd, to speak with management in order to review their security footage. While speaking with management, Chief Meade received a call that the suspect we were looking for was on the property. Officer Pavao and Chief Meade responded in order to locate and identify the suspect. Upon the suspect observing police, he took off running across Mystic Ave into the Ten Hills neighborhood. Officer Pavao and Chief Meade gave chase, but lost sight of the suspect on Bailey Rd.

 

I responded to the Governor Winthrop Rd at Shore Drive and notified Somerville dispatch of the situation. I requested additional units to respond to set up a perimeter. Officer Roger Desrochers (200), Officer Anthony Manzelli (C2), Officer Erik Ubeda (East 3), Officer Doug Brioso (East 2), Officer Joseph Moreira (West 5), Detective Rob Pasqualino (D6), Detective Ariel Collazo (D24), and Detective Mike Faria (D8) responded and secured a perimeter around Bailey Rd and Governor Winthrop Rd between Shore Drive and Temple Rd. I also requested the assistance of K9 Officer Tim Sullivan and his partner K9 Lobo.

 

Upon arrival of K9 Officer Sullivan, I provided him with a description and a last known location. Officer Sullivan deployed K9 Lobo in the rear of 126-128 Governor Winthrop Rd to begin a search (See Officer Sullivan’s supplemental report). While the dog was deployed, other officers radioed that a male matching the description was now running from that address. Multiple officers gave chase as the suspect ran east through the yards, reversing direction in the area of 102 Governor Winthrop. I located the suspect again in the yard of 104 Governor Winthrop where I gave the commands “Police, stop and get on the ground”. The suspect ignored my commands and ran westbound through the yards. I came face to face with the suspect in the yard of 108 Governor Winthrop Rd where I drew my department issued firearm and ordered the suspect to stop and get on the ground. The suspect complied and dropped to his knees, where Officer Joe Moreira was able to place him into custody.

 

Once in custody, Officer Desrochers read Miranda warnings from a card he keeps in his pocket. The suspect stated he understood his rights and wished to speak with us. The suspect was identified as Filsdym Modan, a male well known to the Somerville Police Department. Modan stated he was walking his bicycle through the Mystic Projects with ZZZZZ, but he never entered a building. I know from past dealings that Modan was trespassed (in writing) from the Somerville Housing Authority Property on February 23, 2016. Modan’s belongings were inventoried, and a black Lenovo Thinkpad was located in his back pack. I asked Modan where he got the laptop, and he stated he bought it off some unknown individual in the housing development for $50. Any individual could make the reasonable assumption that a laptop computer costs much more than $50. The low price suggests the item would be stolen. Modan could not provide any proof of purchase, or information from the person he allegedly purchased it from. While speaking with Modan, Officer Moreira and Chief Meade made contact with the witness in order to perform a show up. Once notified by Officer Moreira of the positive identification, I informed Modan he was under arrest for Breaking and Entering during the day time (266/18), Receiving Stolen Property under $250 (266/60), Trespass after notice (266/120), and Resisting arrest (268/32B). Modan was transported by Officer Desrochers in Unit 200 where he was booked in the usual manner by Sgt. Michael Holland.

 

The computer, as well as identification paperwork will be entered into evidence.
